V 7 1974 <br />t <br />JACK .JENNINGS, COUNTY ADMINISTRATOR INFORMED THE BOARD <br />OF A PETITION RECEIVED FROM D. VICTOR KNIGHT, RIVERFRONT GROVES, <br />.JIMMY B. AND ANNA WALKER, AND NANCY ZIKE REQUESTING THE BOARD'S <br />APPROVAL TO PAVE A SECTION OF 49TH STREET (L.INDSEY ROAD) BETWEEN <br />OLD U. S.#1 AND NEW U.S.E. <br />THE ADMINISTRATOR STATED THAT THIS IS A HEAVILY TRAVELLED <br />ROAD AND HE RECOMMENDED PAVING IT. THE COUNTY HAS THE DEED FOR A <br />60 FOOT RIGHT-OF-WAY AND THE WORK COULD BE DONE BY COUNTY FORCES. <br />ON MOTION BY COMMISSIONER MASSEY, SECONDED BY COMMISSIONER <br />DRITENBAS, THE BOARD UNANIMOUSLY AUTHORIZED PAVING OF A SECTION <br />OF 49TH STREET BETWEEN OLD U.S,#1 AND NEW U.S.4 BY COUNTY <br />4 <br />FORCES. <br />MR. JENNINGS STATED THAT SOMETIME AGO, THE BOARD IN- <br />STRUCTED HIM TO MEET WITH OFFICIALS OF THE FELLSMERE WATER <br />MANAGEMENT DISTRICT IN ORDER TO ESTABLISH A PROCEDURE FOR <br />MAINTAINING ROADS IN THIS DISTRICT. ALL ROADS IN THE DISTRICT <br />ARE THE PROPERTY OF THE FELLSMERE WATER MANAGEMENT DISTRICT AND THE <br />COUNTY HAS NO RESPONSIBILITY TO MAINTAIN THEM, BUT HAS, IN THE <br />PAST, MAINTAINED SOME OF THE HEAVILY TRAVELLED ONES. <br />MR. JENNINGS CONTINUED THAT HE DID MEET WITH THESE OFFICIAL: <br />AND THEIR ATTORNEY AND THEY HAVE PREPARED A LIST OF ROADS THEY <br />WOULD LIKE THE COUNTY TO MAINTAIN. THEY HAVE EXECUTED AN EASEMENT <br />WHICH ALLOWS THE COUNTY TO GO OVER THEIR RIGHTS-OF-WAY, BUT THE <br />WATER MANAGEMENT DISTRICT WILL CONTINUE TO HOLD TITLE TO THESE <br />ROADS, <br />MR. KENNINGS STATED THAT THERE IS NOT ENOUGH CLEARED <br />RIGHT-OF-WAY TO BUILD A ROAD. ON A 40 FOOT EASEMENT THERE IS A. <br />DRAINAGE DITCH THAT THE WATER MANAGEMENT DISTRICT MAINTAINS. <br />THE FOLLOWING RECOMMENDATIONS TO THE FELLSMERE ►'CATER <br />MANAGEMENT DISTRICT WERE DISCUSSED BY THE BOARD. <br />1. CONDUCT SURVEY WORK TO ESTABLISH RIGHTS-OF-WAY. <br />2. CONTACT ALL PROPERTY OWNERS TO MOVE THEIR FENCES OFF RIGHT -OF <br />WAY PROPERTY. <br />3. BE RESPONSIBLE FOR CLEARING RIGHTS-OF-WAY. <br />4. DEDICATE TO THE COUNTY THE ROADS THE COUNTY IS TO MAINTAIN. <br />-11- <br />
