ARTICLES OF AGREEMENT <br />THIS AGREEMENT Made this 9th clay of October 1974, <br />between the BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, party of the first part, and the GIFFORD JAYCEES, <br />INC. , party of the second part; <br />WITNESSETH: <br />That said party of the second part shall first make the payments and <br />perform the covenants as hereinafter mentioned on its part to be made and <br />performed and the said party of the first part hereby covenants and agrees <br />to convey and assure said party of the second part, its heirs, executors, <br />administrators or assigns in fee simple and clear of all encumbrances by <br />good and sufficient deed, the land situated in the County of Indian River, <br />State of Florida, known and described as follows, to -wit: <br />Lot 9, Block 9, SMITH PLAZA <br />SUBDIVISION, as shown in the <br />official records of Indian River <br />County, Florida, in Plat Bk 1, <br />page 18 <br />and said party of the second part hereby covenants and agrees to pay to the <br />said party of the first part the sum of $1, 200. 00 in the following manner: <br />A minimum payment of $25. 00 per month until the total sum due is <br />paid. Said party of the second part further covenants and agrees to pay all <br />taxes and assessments and impositions that may be legally levied or imposed <br />on said land, subsequent to the year 1974, and to keep the buildings on said <br />premises insured in some company satisfactory to the party of the first part . <br />.and payable to the parties, respectively as their interests may appear in a <br />sum not less than $1, 200. 00 during the term of this agreement and to further <br />maintain a policy of general liability insurance in an amount not less than <br />$100, 000. 00 upon which the party of the first part shall be shown as an <br />additional insured. In addition, the party of the second part covenants and <br />agrees that these Articles of Agreement are not subject to assignment <br />without the written consent of the party of the first part.
