Findings will be published as r2 - <br />posed amendments to the existing Ordinance <br />and (Zoning) map." <br />Adley & Associates were apparently paid for such a review <br />under their companion contract of October 10, 1972, but, as <br />noted earlier, neither the planning department nor the County <br />Zoning Commission have been willing to incorporate such changes <br />in the implementing Ordinance they are recommending to you <br />(Exhibit C). Our proposed Ordinance, (Exhibit D) on the other <br />hand, would clearly discharge this obligation. In this connec- <br />tion, reference should be made to the current contract entered <br />into on October 3, 1974 relating to "Impact Zoning, Phase II - <br />Incorporation into Zoning Ordinance" which requires modifica- <br />tion of present zoning regulations to include impact zoning <br />procedures. <br />While there are areas of your planning activity that may <br />bear closer scrutiny in the discharge of your elected responsi- <br />bilities to the citizens of this County, we have brought to <br />your attention those which appear to be most significant and <br />which are most likely to subject your planning activity to <br />challenge. They are basically: <br />(1) A lack of required citizens participation. <br />(2) A disregard for the enforceability of the <br />plan; i.e., to use the plan as a mere guide <br />to future rezoning rather than to conform <br />zoning and future land use to the plan (sub- <br />ject of course to due process and annual <br />review of the plan). <br />(3) A potential for disregarding implementation <br />of impact zoning procedures in your zoning <br />regulations. <br />CURING THE PROBLEMS <br />(1) We don't know whether the first problem; namely,lack <br />of adequate citizen's participation, can be cured at this late <br />date. Certainly, it cannot be cured without the consent of the <br />DCA and, even possibly HUD. To say that this Association may <br />have attended and/or been represented at most workshops and <br />hearings concerning the plan does not answer for the lack of <br />notice to and absence of other citizens and interested elements <br />in the community. However, This Association is not in favor. of <br />repeating the last four years to insure adequate citizen's par- <br />-8- <br />3 27 <br />
