4 1975 <br />1 have prepared alternative paragraphs on Legal Effects in <br />the event a majority feel that the plan should be something more than a <br />guide. <br />Section 5. Legal Effect on Present and Future Development: <br />(1) Present Development <br />The Comprehensive Plan as adopted herein shall <br />have no effect currently on present development. Real property owners <br />Shall have five years from the date of adoption of this ordinance in which <br />to begin development under present zoning. Thereafter all development <br />shall be in compliance with the following paragraph. <br />(2) Future Development <br />No public or private development shall be permitted <br />except in conformity with the Comprehensive Plan, elements or portions <br />thereof herein adopted except under the following circumstances: <br />(a) The public body before whom an application for <br />development, not in conformity with the Comprehensive Plan, must find <br />that the area to be developed is ripe for development to the use being pro- <br />posed, and <br />(b) There is a need for the change. and <br />(c) the proposed development is not against the <br />public interest, and <br />(d) the body finds and recommends that the cir- <br />cumstances demonstrate a need for revision to the Comprehensive Plan <br />to reflect the requested development. <br />gm 23 F'AGE <br />
