<br /> HIGHWAY 1, SAID LAND LYING IN INDIAN RIVER COUNTY,FLORIDA tfi
<br /> WHEREAS, on May 24, 2002, Indian River County received a duly executed and
<br /> documented petition from Graves Brothers,Inc. of Florida,requesting that the County close,vacate,
<br /> abandon,discontinue,renounce and disclaim any right,title and interest of the County and the public
<br /> in and to a portion 84th Place lying between Old Dixie Highway and U.S.Highway 1 as shown on the
<br /> plat of the Graves Addition to Wabasso subdivision and recorded in Plat Book 2, Page 41 of the
<br /> public records of Indian River County,Florida,said lands lying in Indian River County,Florida;and N

<br /> WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to
<br /> consider said petition was duly published; and w

<br /> WHEREAS,after consideration of the petition,supporting documents,staff investigation and
<br /> report,and testimony of all those interested and present,the board finds that the subject right-of-way
<br /> is not a state or federal highway, nor located within any municipality, nor is said right-of-way w
<br /> necessary for continuity of the County's street and thoroughfare network, nor access to any given
<br /> private property.
<br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
<br /> COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that:

<br /> _t 1. All right, title and interest of the County and the public in and to that certain right-of-way
<br /> .tsQ being known more particularly as:

<br /> -r s Situated in the State of Florida,County of Indian River and being a part of Graves Addition
<br /> to Wabasso subdivision as recorded in Plat Book 2,Page 41 of the public records of Indian
<br /> River County,Florida, and being more particularly bounded and described as follows:

<br /> All of that 84`h Place,(5`h Street South-Plat)bounded on the north by the south line of Block
<br /> 2,of said Graves Addition;bounded on the east by the ultimate westerly right-of-way line of
<br /> U.S. Highway No. 1; bounded on the south by the north line of Block 3, of said Graves C)
<br /> Z11- addition; bounded on the west by the ultimate easterly right-of-way line of Old Dixie --
