RESOLUTION NO. 2004-090 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, SUPPORTING ESTABLISHMENT OF A CVS DISTRIBUTION <br />CENTER WITHIN THE. PROPOSED INDIAN RIVER PARK OF COMMERCE. <br />WHEREAS, Indian River County desires to implement Economic Development Element <br />Policies 1.1, 1.2, 1.3, 2.3, 2.4, and Future Land Use Element Policy 1.36 of the County's <br />Comprehensive Plan; and <br />WHEREAS, Indian River County desires to provide expanded fire protection, water and <br />sewer facilities, and roadway improvements to a proposed CVS distribution center; and <br />WHEREAS, CVS will build a distribution center within the Indian River Park of <br />Commerce, provided that the site has needed access to State Road 60 via proposed 98th Avenue, <br />100th Avenue and 22°a Street and provided that the site is served with municipal water and sewer <br />services so as to provide adequate fire protection and sanitary conditions; and <br />WHEREAS, the Indian River County Board of County Commissioners is planning to apply <br />for a grant in the amount of $750,000 from the Community Development Block Grant Program to <br />partially fund the improvements needed to serve the site; and <br />WHEREAS, the applicant's qualified engineers prepared cost estimates, certified by the <br />County Engineer's office, that show the estimated bid amount to construct the needed facilities, <br />together with grant administration and engineering costs will exceed $750,000; and <br />WHEREAS, the County, as an incentive to bring jobs to the County, has $1,500,000 of <br />funding available within its General, Secondary Roads Construction, Optional Sales Tax, and <br />Utilities Funds that may be used for infrastructure facilities construction and related activities; and <br />WHEREAS, until the point of expenditure, the County retains the right to seek alternative <br />sources, other than the $1,500,000 in County funds, for the required infrastructure facilities <br />construction. If the County is successful in obtaining alternative sources of funds, the County <br />reserves the right to deduct the alternative funding from the County's reserve amount so that <br />alternative sources fund the needed facilities instead of County funds. <br />NOW, THEREFORE, BE IT RESOLVED that the Indian River County Board of County <br />Commissioners commits up to $1,500,000 of the County's funds for required infrastructure <br />facilities construction (as shown by attachment A), contingent on the execution of a developer's <br />agreement that specifies responsibilities of each party. Said funds to be used for the construction of <br />needed infrastructure facilities to serve the proposed CVS distribution center within the Indian <br />River Park of Commerce. <br />PASSED AND ADOPTED. The foregoing resolution was offered by Commissioner <br />Adams and the motion was seconded by Commissioner.
