WANTED TO HAVE THE FLEXIBILITY OF 15 CLUSTERED HERE AND THERE, IR, CAIRNS <br />POINTED OUT THAT THEY ARE ALREADY ZONED R-2, AND HE FELT AN AGREEMENT <br />SUCH AS HE IS SUGGESTING WOULD BE HELPFUL TO THE COUNTY RATHER THAN <br />CREATING MORE AND MORE ZONING CLASSIFICATIONS, !1E CONTINUED THAT HE HAS <br />ALREADY SIGNED AN AGREEMENT SUCH AS ATTORNEY COLLINS DISCUSSED WHICH <br />WOULD AGREE ON AN OVERALL DENSITY, <br />CHAIRMAN LOY ASKED IF THIS HAS BEEN DONE IN THE STATE OF FLORIDA, <br />ATTORNEY KENDALL SHARP, REPRESENTING MR, CAIRNS, SAID THAT IT <br />HAS BEEN AND IS DONE A LOT IN THE ORLANDO AREA, AND IT HAS NEVER BEEN <br />BROUGHT TO COURT IN FLORIDA, <br />VAL BRENNAN, PLANNING DIRECTOR, INFORMED THE BOARD THAT HE HAS <br />REVIEWED MR, CAIRNS` AGREEMENT, NOT FROM A LEGAL POINT OF VIEW BUT FROM A <br />PLANNING POINT OF VIEW, HE STATED THAT HE LIKES THE FACT THAT THE AGREE- <br />MENT WILL BE SIGNED BY BOTH THE COMMISSIONERS AND THE OWNERS WHICH MAKES <br />IT MUCH STRONGER THAN A DEED RESTRICTION BY THE OWNER WHICH CAN BE TORN <br />UP AT ANY TIME, BUT ADDED THAT HE DID HOPE THAT SUCH AN AGREEMENT WOULD <br />NOT CAUSE THE COUNTY TO GIVE UP ITS RIGHT TO REZONE THIS PROPERTY AT ANY <br />TIME IN THE FUTURE, <br />ATTORNEY SHARP STATED THAT BEFORE THE NEW ORDINANCES WERE BROUGHT <br />OUT, THE REPRESENTATION WAS MADE THAT THIS PROPERTY WOULD BE HELD TO 8 <br />UNITS PER ACRE, AND BY THIS AGREEMENT, WE ARE LIMITING OURSELVES TO THE <br />ORIGINAL REPRESENTATION, <br />COMMISSIONER SIEBERT STATED THAT THE IDEA IS FINE, BUT HE FELT <br />THE BOARD SHOULD HAVE TIME TO STUDY THIS SITUATION BEFORE SIGNING ANYTHING, <br />MR, CAIRNS STATED THAT HE HAD A PROBLEM WITH A TIME LIMIT AS <br />HE WOULD LIKE TO HAVE THIS AGREEMENT SIGNED BEFORE HE SOLD THE PROPERTY, <br />MR, BRENNAN NOTED THAT THE ZONING COMMISSION -MEETS AGAIN TO- <br />MORROW NIGHT, AND THEY HEARTILY RECOMMENDED THE PREVIOUS AGREEMENT WHICH <br />WAS PRESENTED TO THEM, <br />ATTORNEY COLLINS STATED THAT HE FELT IF THE COUNTY SIGNED THIS <br />CONTRACT, IT MAY WELL WORK AS AN ESTOPPEL ON A FUTURE BUYER, <br />CHAIRMAN LOY STATED SHE FELT IT WAS THE GENERAL OPINION OF THE <br />BOARD THAT THIS MATTER WOULD HAVE TO BE CONSIDERED FURTHER BEFORE SIGNING <br />THE AGREEMENT, AND IT WOULD BE BROUGHT UP AGAIN AT THE NEXT REGULAR MEET- <br />ING OR POSSIBLY AT A SPECIAL MEETING. <br />-29- <br />NOV 51975 <br />BON .Nta125 <br />
