RESOLUTION NO. 2002- 110 <br /> A RESOLUTION OF THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER <br /> COUNTY,FLORIDA, DECLARING THE SOUTH <br /> GIFFORD ROAD LANDFILL SITE IN INDIAN <br /> RIVER COUNTY, FLORIDA, A BROWNFIELD <br /> UNDER THE B R 0 W N F I E L D S <br /> REVITALIZATION AND ENVIRONMENTAL <br /> RESTORATION ACT OF 2001. <br /> WHEREAS, the fifty-five acre South Gifford Road Landfill site, located south of 41 St <br /> Street in Indian River County, Florida, and depicted in Exhibit"A", attached hereto, ("South <br /> Gifford Road Landfill site") had been used since the early nineteen forties for solid waste <br /> disposal; and <br /> WHEREAS, during or after World War II solid waste from military use of the Vero <br /> Beach municipal airport was reportedly buried in the general area of the South Gifford <br /> Road Landfill site; and <br /> WHEREAS, Indian River County, a political subdivision of the State of Florida, <br /> operated the South Gifford Road Landfill site as a landfill from approximately 1960 to 1977; <br /> and <br /> WHEREAS, initial testing conducted in 1995 in connection with closure activities at <br /> the South Gifford Road Landfill revealed various levels of groundwater contamination; and <br /> WHEREAS, the Indian River County Board of County Commissioners recognizes <br /> the importance of identifying and resolving contamination issues within its jurisdiction, to <br /> ensure the public health, welfare, and safety, and to promote responsible, sound <br /> redevelopment of such affected property; and <br /> WHEREAS, the South Gifford Road Landfill site constitutes real property, the <br /> expansion, redevelopment, or reuse of which may be complicated by the presence or <br /> potential presence of a hazardous substance, pollutant, or contaminant, and qualifies as <br /> a brownfield site under the Brownfields Revitalization and Environmental Restoration Act <br /> of 2001, <br /> NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of <br /> Indian River County, Florida, as follows: <br /> 1. The Board of County Commissioners declares that the South Gifford Road <br /> Landfill site, located south of 41s' Street in Indian River County, Florida, and depicted in <br /> Exhibit "A", attached hereto, constitutes real property, the expansion, redevelopment, or <br /> reuse of which may be complicated by the presence or potential presence of a hazardous <br />
