RESOLUTION NO. 2004- 123 <br /> A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br /> INDIAN RIVER COUNTY, FLORIDA, FORMALLY ACCEPTING SOLELY <br /> FOR PUBLIC UTILITY PURPOSES THE DEDICATION OF 55TH COURT, <br /> SOUTH OF 13TH STREET SW, AS SET FORTH ON THE PLAT OF <br /> GREENLEAF SUBDIVISION. <br /> WHEREAS, it is necessary for Indian River County to expand the County's water <br /> system to serve properties in the area of Greenleaf Subdivision, 55th Court south of 13th <br /> Street SW; and <br /> WHEREAS, in connection with this, it is necessary for the County to formally <br /> accept 55th Court, south of 13th Street SW, as set forth on the plat of Greenleaf <br /> Subdivision solely for public utility purposes as offered by the owners and developers of <br /> Greenleaf Subdivision in the Certificate of Dedication, as recorded in Plat Book 11, Page <br /> 39, of the public records of Indian River County, Florida; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the Board of County <br /> Commissioners hereby formally accepts for utility purposes only, all of the street that is <br /> 55th Court, south of 13th Street SW, on the plat of Greenleaf Subdivision together with all <br /> easements set forth on the plat of Greenleaf Subdivision solely for utilities purposes. <br /> The resolution was moved for adoption by Commissioner Adams j <br /> and the motion was seconded by Commissioner Lowther and, upon <br /> being put to a vote, the vote was as follows: <br /> Chairman Caroline D.
