�1q1� <br /> RESOLUTION NO. 2005- 121 <br /> A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br /> OF INDIAN RIVER COUNTY DELEGATING TO THE COUNTY <br /> ADMINISTRATOR OR DESIGNEE THE AUTHORITY TO EXECUTE <br /> STANDARD CONTRACTS FOR CONSTRUCTION OF REQUIRED <br /> IMPROVEMENTS AND STANDARD WARRANTY AND <br /> MAINTENANCE AGREEMENTS ISSUED UNDER SECTION 913.10 <br /> OF THE CODE OF INDIAN RIVER COUNTY. <br /> WHEREAS, pursuant to sections 913.10(1) and 913.10(2), respectively, of The <br /> Code of Indian River County, the Indian River County Board of County Commissioners <br /> (Board) routinely executes standard contracts for construction of required <br /> improvements and standard warranty and maintenance agreements (collectively <br /> referenced as "subdivision agreements") from developers in connection with the <br /> completion and/or maintenance of required subdivision or planned development <br /> improvements; and <br /> WHEREAS, it is in the best interests of the County and the public to be able to <br /> provide the "subdivision agreements" in an expeditious manner; and <br /> WHEREAS, the execution of these "subdivision agreements" is administrative in <br /> nature and does not require the attention of the Board; <br /> WHEREAS, The Code of Indian River County section 101.05.1.q. allows the <br /> Board to authorize the County Administrator, or his designee, to perform other duties on <br /> behalf of the Board; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY that: <br /> The Board hereby delegates the authority to the County Administrator, or <br /> designee, to execute "subdivision agreements" that are in the County's standard form <br /> pursuant to section 913.10 of The Code of Indian River County, with the approval <br /> signature of the County Attorney, or designee. <br /> The resolution was moved for adoption by Commissioner Wheel er , <br /> and the motion was seconded by Commissioner Davi s and, upon <br /> being put to a vote, the vote was as follows: <br /> Chairman Thomas S. Lowther Aye <br /> Vice Chairman Arthur R. Neuberger Aye <br /> Commissioner Wesley S. Davis Aye <br /> Commissioner Gary C. Wheeler Aye <br /> Commissioner Sandra L. Bowden Absent <br />
