The Local Government Half-Cent Sales Tax proceeds collected within a county are distributed to <br /> the county and municipal governments by the State in accordance with the following formulas: <br /> County's share(Percentage of unincorporated 2/3 incorporated <br /> total Local Government Half- = area population + area population <br /> Cent Sales Tax receipts) total county + 2/3 incorporated <br /> population area population <br /> Municipality's share <br /> (percentage of total Local = municipality_population <br /> Government Half-Cent Sales total county + 2/3 incorporated <br /> Tax receipts) population area population <br /> Population is the latest officialstate estimate ofpopulationcertified prior to the beginning ofthe local <br /> government fiscal year. <br /> Because distribution of the Local Government Half-Cent Sales Tax is based on the population of <br /> unincorporated areas within the County relative to the population of incorporated municipalities within the <br /> County,the County's share ofthe Sales Tax would be reduced ifunincorporated areas ofthe County were <br /> to be annexed by an existing municipality within the County or ifunincorporated areas ofthe County were <br /> to become incorporated municipalities. <br /> Under Section 165.041,Florida Statutes,a charter for incorporation of a new municipality must <br /> be adopted by a special act ofthe Florida Legislature,after a determination that certain standards set forth <br /> in Section 165.041, Florida Statutes, have been met. As applied to any new municipality within the <br /> County,those standards include the following: <br /> (a) The new municipality must have a total population of at least 5,000 persons; <br /> (b) The new municipality must have an average population density of at least 1.5 persons per <br /> acre except under certain extraordinary conditions; and <br /> (c) Any part of the new municipality's proposed boundaries must be at least two miles from <br /> the boundaries of an existing municipality within the County contiguous and amicable to separate municipal <br /> government. <br /> Under Section 171.041(3), Florida Statutes, a municipality may annex contiguous, compact, <br /> unincorporated territory by adopting an annexation ordinance. Following adoption,such ordinance must <br /> be submitted to a separate vote of the registered electors of the annexing municipality and the registered <br /> electors ofthe area proposed to be annexed. Ifthere is a separate majority vote for annexation in both the <br /> annexing municipality and in the area proposed to be annexed, then the ordinance of annexation shall <br /> 15 <br />
