DRINKARD TO SUBDIVIDE HIS PROPERTY ON <br />PELICAN LANE INTO TWO 100 FOOT PARCELS. <br />CHAIRMAN SIEBERT STATED THAT THIS IS A UNIQUE SITUATION AND IT DOES <br />CREATE A HARDSHIP'FOR MR, DRINKARD AND THAT THE PURPOSE OF THE BOARD OF <br />ZONING ADJUSTMENT IS TO EVALUATE THIS TYPE OF PROBLEM, <br />CHAIRMAN SIEBERT CONTINUED THAT IT APPEARS THAT IF A VARIANCE WAS i <br />GRANTED AND THE PROPERTY SUBDIVIDED INTO TWO PARCELS, UNDER ORDINANCE NO. i <br />74-20 IT WOULD HAVE BEEN DIVIDED AFTER 1973, AND QUESTIONED IF WE WOULD HAVE <br />TO GRANT AN EXCEPTION TO ORDINANCE N0. 74-20. <br />ATTORNEY COLLINS STATED THAT HE WOULD HAVE NO OBJECTION TO THE i <br />BOARD GRANTING AN EXCEPTION TO ORDINANCE N0. 74-20, BUT IT IS HIS RE— <br />COMMENDATION THAT THIS REQUEST GO TO THE BOARD OF ZONING ADJUSTMENT FOR <br />THEIR APPROVAL. <br />ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER <br />WODTKE, THE BOARD UNANIMOUSLY GRANTED AN EXCEPTION TO ORDINANCE N0. 74-20 <br />FOR A PARCEL OF LAND OWNED BY DONALD DRINKARD AND DESCRIBED AS GOVERNMENT <br />.NO, 3, SECTION 16, TOWNSHIP 33 AND RANGE 40 AND RECORDED IN THE OFFICIAL <br />RECORD BOOK 442, PAGE 235. <br />DISCUSSION FOLLOWED AND A MOTION WAS MADE BY COMMISSIONER SCHMUCKER, <br />SECONDED BY COMMISSIONER Loy, TO REFER. THE REQUEST OF DONALD DRINKARD <br />TO DIVIDE HIS PROPERTY ON PELICAN LANE INTO TWO — 100 FOOT LOTS TO THE <br />BOARD OF ZONING ADJUSTMENT; THAT IT BE PUT ON THEIR AGENDA AS SOON AS <br />POSSIBLE; THAT THEY BE GIVEN A COPY OF THIS BOARDS MINUTES IN WHICH MR. <br />DRINKARD WAS GRANTED AN EXCEPTION TO ORDINANCE NO. 74-20, <br />DISCUSSION FOLLOWED AND MR. DRINKARD QUESTIONED WHAT COURSE OF <br />ACTION HE WOULD HAVE IF THE BOARD OF ZONING ADJUSTMENT DENIED HIS REQUEST. <br />CHAIRMAN SIEBERT STATED THAT IF THIS WERE TO HAPPEN HE WOULD RE— <br />COMMEND THAT THIS REQUEST APPEAR BEFORE THIS BOARD AGAIN FOR FURTHER REVIEW <br />BECAUSE OF THE HARDSHIP INVOLVED, <br />THE CHAIRMAN CALLED FOR THE MOTION; THE BOARD UNANIMOUSLY APPROVED <br />AND THE MOTION WAS CARRIED. — <br />FEB41976 �t�9 25 Marc 14 <br />
