(k) rating changes; (iii) in a timely manner, to each NRMSIR or to the .MSRB and to the SID, notice of a failure by the County to provide the required annual financial information on or before the date specified in its written continuing disclosure undertaking. The County reserves the right to modify from time to time the specific types of information provided or the format of the presentation of such information, to the extent necessary 'or appropriate in the judgment of the County; provided, that the County agrees that any such modification will be done in a manner consistent with the Rule. The County reserves the right to terminate its obligation to provide annual financial information and notices of material events, as set forth above, if and when the County no longer remains an "obligated person" with respect to the Bonds within the meaning of the Rule. The County acknowledges that its undertaking pursuant to the Rule described under this subheading is intended to be for the benefit of the owners of the Bonds and shall be enforceable by the owners; provided, that the right to enforce the provisions of this undertaking shall be limited to a right to obtain specific enforcement of the County's obligations hereunder, and any failure by the County to comply with the provisions of this undertaking shall not be an event of default with respect to the Bonds under the Resolution. The requirements of (i) above, do not necessitate the preparation of any separate annual report addressing only the Bonds. The requirements of (i) may be met by the filing of a combined bond report or the County's Comprehensive Annual Financial Report; provided, such report includes all of the required information and is available by June 1. Additionally, the County may incorporate any information provided in any prior filing with each NRMSIR or included in any final official statement of the County, provided such final official statement is filed with the MSRB. 34
