ATTORNEY COLLINS DISCUSSED THE MATTER OF SURVEYING THE LAND <br />RECENTLY ACQUIRED IN THE TOWN OF INDIAN RIVER SHORES. <br />ON MOTION BY COMMISSIONER Loy, SECONDED BY COMMISSIONER <br />SCHMUCKER, THE BOARD UNANIMOUSLY AUTHORIZED THE ATTORNEY TO EMPLOY LLOYD <br />& ASSOCIATES TO PREPARE A SURVEY, INCLUDING TOPOGRAPHY AND ELEVATIONS, <br />OF THE PROPERTY IN THE TOWN OF INDIAN RIVER SHORES RECENTLY PURCHASED BY <br />THE BOARD FOR PARK PURPOSES, <br />CHRISTOPHER EKONOMOU APPEARED IN REGARD TO CORRECTION OF A <br />DEDICATION PERTAINING TO SOUTH SIDE PARK SUBDIVISION. <br />ATTORNEY COLLINS SUMMARIZED THE PROBLEM, SOUTH SIDE PARK <br />SUBDIVISION IS ONE OF THE OLDER PLATS IN THE COUNTY AND HAS BEEN ON RECORD <br />FOR A CONSIDERABLE PERIOD OF TIME. IT IS LOCATED WEST OF 6TH AVENUE <br />AND EAST OF 7TH AVENUE. 6TH AND 7TH AVENUES ARE UNUSUAL IN THAT PROPERTY <br />OWNERSHIP GOES ALL THE WAY OUT TO THE MIDDLE OF THE ROAD AND THUS THE <br />ROADS ARE ACTUALLY PRIVATELY OWNED, WHEN THE PLAT WAS PUT ON RECORD IT WAS <br />INTENDED TO HAVE A 70' RIGHT-OF-WAY FOR ROAD PURPOSES. THE ENTIRE 70' <br />WAS PLATTED ALONG 7TH AVENUE AS PART OF THE SUBDIVISION SO THEY ACTUALLY <br />PLATTED 35' MORE ON THE WEST SIDE OF THE PROPERTY THAN THEY OWNED, <br />ATTORREY COLLINS NOTED THAT MARVIN CARTER OF CARTER ASSOCIATES, INC., HAS <br />WRITTEN A LETTER ACKNOWLEDGING THAT THE DEDICATION IS IMPROPER. <br />ATTORNEY COLLINS CONTINUED THAT THE COUNTY CAN COOPERATE AND <br />TRY TO RECTIFY THE PROBLEM, BUT THEY ACTUALLY DO NOT HAVE ANY RESPONSI- <br />BILITY AS IT IS A PRIVATE PROBLEM. HE STAVED THAT HE WOULD RECOMMEND FIRST <br />THAT ALL THE 35' ON THE WESTERN PORTION OF THE PLAT BE VACATED; THEN HE <br />WOULD ADVISE MR. EKONOMOU TO OBTAIN QUIT CLAIM DEEDS FROM ALL THE PROPERTY <br />OWNERS IN THE SUBDIVISVON TO THEIR INTEREST IN THE 35'; ALSO, WHEN YOU <br />VACATE PROPERTY, THE OWNERS ON EACH SIDE OWN HALF OF IT AND THESE ABUTTING <br />OWNERS MAY HAVE TO RELEASE THEIR PORTION EVEN THOUGH THEY DON'T HAVE ANY <br />INTEREST. <br />THE ADMINISTRATOR INFORMED THE BOARD THAT THE ROAD THAT JSTNOW IN <br />EXISTENCE AND MAINTAINED BY THE COUNTY IS ON THE EAST 1/2 OF 7TH AVENUE. <br />IT WAS NEVER BUILT ON THE FULL 70' RIGHT-OF-WAY, <br />13 <br />m, <br />Y 51-97 ear 25 -*-3-32 �. <br />f� <br />
