County's available allocation from the City; and <br />WHEREAS, the City, County and College wish to enter into a <br />Tripartite Agreement pursuant to the provisions of Paragraph <br />Four (4) of the certain Agreement between the City and the County, <br />dated January 11, 1973, a copy of said Agreement being attached <br />hereto as Exhibit "B". <br />N(W, THEREFORE, in consideration of the foregoing and <br />the covenants contained herein, the parties hereto agree as <br />follows: <br />1. The County hereby releases the property described <br />in Exhibit "A", attached hereto, from its water service area <br />as originally set forth in that Agreement between the City and <br />the County, dated January 11, 1973, attached hereto as <br />Exhibit "B", and the County further gives its approval to <br />the City to enter into an Agreement with the College for the <br />provision of permanent water service to the property owned <br />by the College and described in Exhibit "A", attached hereto. <br />2. The City hereby agrees to provide permanent water <br />service to the College under the terms and conditions of <br />applicable City Ordinances. <br />3. The water service provided by the City to the <br />College shall be considered part of the capacity allocated <br />to the County at the City's water treatment plant, as provided <br />and set forth in Paragraph 5 of Annex I of the Agreement <br />between the City and County, dated January 11, 1973. <br />4e. That City, County and College agree that County <br />is releasing up to a maximum of 31,500 gallons per day from <br />its allocation. In the event the gallonage used by the <br />..College exceeds 31,500 gallons per day, that increase shall be <br />the responsibility of City and shall not apply against County's <br />available allocation. <br />5.
