ATTORNEY COLLINS STATED THAT THE PARK CAN BE CLOSED, BUT <br />UNLESS SOMETHING AFFIRMATIVE IS DONE, PEOPLE WILL STILL GO IN, AND <br />POINTED OUT THAT THERE IS A DIRT CAUSEWAY LEADING INTO THIS SECTION <br />OF THE PARK BY WHICH PEOPLE CAN GET ACCESS TO THE RIVER, HE FELT IF <br />THIS CAUSEWAY WERE SEPARATED, THAT MIGHT SOLVE THE PROBLEM AND PREVENT <br />PEOPLE FROM ENTERING THE RIVERFRONT SECTION OF THE PARK, <br />THE AwINISTRATOR INFORMED THE BOARD THAT THIS PARK HAD BEEN SO <br />SEVERELY VANDALIZED OVER THE YEARS THAT THE COUNTY HAS DISCONTINUED TRYING <br />TO MAINTAIN ANY FACILITIES THERE, <br />DISCUSSION FOLLOWED ON WHETHER. MR. THOMPSON HAD EVER PERFECTED <br />HIS WATER RIGHTS; WHETHER HE HAD A PERMIT FOR HIS DOCK; AND WHETHER IT <br />BLOCKED PEOPLE WADING IN THE RIVER, <br />MR. THOMPSON STATED THAT HE HAD NEVER PERFECTED HIS WATER <br />RIGHTS; BUT THAT THE DOCK WAS "GRAND -FATHERED" IN AND DID NOT BLOCK <br />ANYONE AS THEY COULD GO AROUND IT, <br />COMMISSIONER WODTKE MADE A MOTION, SECONDED BY COMMISSIONER <br />Loy, THAT THE BOARD CLOSE THE PORTION OF AMBERSAIm BEACH PARK, LYING <br />WEST OF STATE ROAD AIA, AND AUTHORIZE THE ADMINISTRATOR TO PROPERLY <br />POST THE AREA AND MAKE WHATEVER CUTS IN THE ENTRANCE ROAD ARE NECESSARY <br />TO MAKE IT IMPASSABLE, <br />COMMISSIONER MASSEY STATED HE WOULD OPPOSE THIS MOTION AS HE <br />DOES NOT FEEL IT IS THE BOARD'S PROVINCE TO DEAL WITH CIVIL MATTERS, <br />SUCH AS TRESPASSING, WHICH SHOULD BE DEALT WITH THROUGH THE COURTS. <br />COMMISSIONER SCHMUCKER AGREED WITH COMMISSIONER MASSEY IN <br />PRINCIPLE BUT SUGGESTED THAT IT MIGHT HELP SOLVE THINGS TO CLOSE THIS <br />SECTION OF THE PARK TEMPORARILY, POSSIBLY SIX MONTHS, AND THEN REVIEW <br />THE SITUATION, <br />MR. THOMPSON STATED THIS WOULD BE AGREEABLE TO HIM AS IT WOULD <br />GIVE HIM TIME TO WORK ON THE POSSIBILITY OF A LAND SWAP, <br />CHAIRMAN SIEBERT NOTED THAT THIS MATTER COULD BE PUT BACK ON <br />THE AGENDA IN SIX MONTHS' TIME AND STATED HE FELT MR. THOMPSON WAS EN- <br />TITLED TO SOME PROTECTION FROM THE FLAGRANT ABUSES THAT HAVE TAKEN PLACE, <br />e <br />THE CHAIRMAN CALLED FOR THE QUESTION, COMMISSIONERS Loy, <br />SCHMUCKER, WODTKE AND CHAIRMAN SIEBERT VOTED IN FAVOR; COMMISSIONER <br />MASSEY VOTED IN OPPOSITION.
