ADMINISTRATOR JENNINGS SUGGESTED THAT MR, JENKINS TAKE ALL THIS <br />INFORMATION TO THE D.E.R. IN ORLANDO AND EXPLAIN THE SITUATION TO SEE IF <br />THERE IS A WAY TO GET A PERMIT TO HAVE THIS FILLED IN SINCE Ia IS PRIVATE <br />PROPERTY AND THE COUNTY IS NOT INVOLVED, 'IF HE COULD OBTAIN SUCH A PER— <br />MIT, THEN POSSIBLY THE. COUNTY MIGHT BE ABLE TO HELP HIM WORK THIS OUT, <br />COMMISSIONER WODTKE NOTED THAT THE COUNTY MIGHT NOT BE ALLOWED <br />TO ENTER INTO IT, AND IT MIGHT HAVE TO BE HANDLED ON A PRIVATE BASI:o <br />ATTORNEY VOCELLE STATED THAT THEY WOULD BE HAPPY TO CONTACT <br />THE D.E.R. AS SUGGESTED AND TRY TO GET A PERMIT, BUT HE WOULD ASK THE <br />BOARD TO GIVE MR, JENKINS SOME CONSIDERATION ON A TEMPORARY BASIS TO GO <br />BACK INTO OPERATION, <br />MR, JENKINS POINTED OUT THAT THEY HAVE STOCK PILES OF DIRT <br />ALREADY THERE WITHOUT HAVING TO DO ANY DIGGING, <br />CHAIRMAN SIEBERT ASKED FOR ATTORNEY COLLINS` OPINION, <br />ATTORNEY COLLINS STATED HE FELT THAT IF YOU DO GRANT ANY LEEWAY <br />IN THIS APPEAL, EVERY OTHER MINER WHO IS TRYING.TO COMPLY WILL FEEL DIFFER- <br />ENTLY THAN IF THE ORDINANCE WERE BEING STRICTLY ENFORCED, AND IF YOU DO <br />ALLOW MR, JENKINS TO CONTINUE, YOU MIGHT CREATE AN ESTOPPEL SITUATION, <br />COMMISSIONER Loy POINTED OUT THAT THIS BOARD, AS WELL AS THE <br />a <br />ZONING BOARD, THE MINERS THEMSELVES, AND OUR STAFF, HAVE WORKED OVER MIN— <br />6 <br />ING PROBLEMS FOR A NUMBER OF YEARS AND HAVE FINALLY COME UP WITH A SET <br />OF REGULATIONS THAT WERE FELT TO BE IN THE BEST INTERESTS OF THE PEOPLE <br />OF THIS COUNTY, SHE, THEREFORE, MADE A MOTION TO DENY THE APPEAL OF <br />MR, JENKINS TO REMOVE THE CEASE AND DESIST ORDER IN VIEW OF THE FACT THAT <br />EVER SINCE MR, JENKINS HAS OWNED THIS PROPERTY, HE HAS VIOLATED THE <br />ORDINANCE AS TO THE REQUIRED 150° SETBACK, MOTION WAS SECONDED BY COM- <br />MISSIONER MASSEY. <br />r <br />DISCUSSION FOLLOWED, AND CHAIRMAN SIEBERT ASKED IF ANYONE COMES <br />UP WITH A PLAN AND INITIATES IT, CAN WE THEN ISSUE THEM A PERMIT? a <br />E <br />C <br />ADMINISTRATOR JENNINGS STATED THAT JUST A PLAN IS NOT ENOUGH, <br />t <br />THE REGULATIONS REQUIRE THAT IT MUST BEBACKED UP WITH ASSURANCE MONEY, <br />DEWEY WALKER STATED THAT MR, JENKINS WILL HAVE TO POST A MINI— <br />MUM BOND OF $5,000,00 BEFORE HE CAN CONTINUE OPERATIONS, <br />10 <br />.j <br />r <br />MAY 10 1916 <br />o F 25 <br />390 <br />_. <br />4 <br />
