MAY 1 76 <br />2 Notification of City <br />This Contract is contingent upon acceptance by the City <br />of -Vero Beach of the COUNTY'S Purchase Agreement with them, and <br />the Agreement by the City of Vero Beach to provide the necessary <br />water. Within fifty (50) days from the date of this Agreement, <br />the COUNTY will give the City of Vero Beach proper notification <br />that the COUNTY intends to activate its Water Purchase Agreement 7 <br />with said City for the purposes stated in this Agreement. In <br />k <br />the event for any reason the City of Vero Beach refuses to supply <br />the necessary water to implement the terms of this Agreement <br />now or at any time during the term of this Agreement, UDU agrees <br />to hold COUNTY harmless and agrees that the parties shall upon <br />COUNTY'S request terminate this Agreement without liability to <br />COUN'RY <br />3. Vater System Interface <br />UDU will furnish, install, operate and maintain at its <br />own expense at the City of Vero Beach's water treatment plant <br />the necessary pumps, pipes, valves, controls, meters, meter house, <br />and accessories under approval of the Cityof Vero Beach, which <br />items mentioned above shall be constructed upon plans approved <br />by COUNTY prior to the beginning of installation.. UDU shall <br />further have the complete responsibility and shall pay the ; <br />expenses of transferring the water from the City of Vero Beach's <br />water treatment plant to UDU'S distribution area as established <br />herein, said responsibility shall include the attainment of all <br />necessary nights -of -way and the payment of all engineering and <br />4 <br />attorneys' fees and other fees and costs involved. The parties <br />agree that the meter located at the water treatment plant in <br />k. w <br />Vero Beach shall be a standard type properly measuring the <br />quantity of water delivered to UDU. COUNTY shall approve the <br />meter prior to its purchase.
