family residential tap -ins to be used by the present water <br />customers of UDU in residential structures existing and by <br />Kiddle Six and Seven Schools, said.existing structures are to <br />the most part identified on Exhibit "A" attached hereto. <br />(2) Allocate (after satisfaction of the stated conditions <br />of this paragraph, i.e, 4(e), 4(g)- and 4 (h)) to UDU for the <br />benefit of any third party customer an additional 225 single- <br />family residential tap -ins ( which includes multiple -family <br />units) conditioned upon the compliance to COUNTY'S satis- <br />faction with paragraph 4 (e) of this Agreement and conditioned <br />upon the third party meeting all State, Federal and County <br />Rules and Regulations for the project involved. <br />C) Thereafter, for a period of six (6) months from completion <br />.of the water distribution system and the beginning of service, <br />COUtMY will allocate additional single-family residential tap -ins <br />as demand arises to UDU-, upon request, from its reserved -allocation <br />for the benefit of existing single-family residential structures <br />within the UDU Franchise area as defined herein and identified <br />as Exhibit "A". During the six (6) months period both COUNTY <br />and uDTJ will advertise this availability of water within the <br />franchise area. <br />d) COUNTY'S total allocation under (b), (c), and (h) not t <br />to exceed the maximum defined in (a) of this paragraph 4. <br />e) UDU agrees to upgrade and make operational the existing <br />sewer facilities in accordance with all County and State require- <br />ments, or in the alternative, UDU agrees to develop another sewage <br />disposal plant with a minimum capacity of 40,000 gallons per day <br />expandable to 100,000 gallons per day, meeting all County and State <br />regulations. Either plant and necessary supplemental lines, pump- <br />ing stations and operating equipment must be installed, operational <br />and on line; fully approved by all Governmental Agencies, owned <br />and <br />free and clear -of encumbrances and liens except for existing <br />f. <br />Farmers Home Administration loans by UDU, and to the extent of the <br />first 40,0^jO gallons capacity of either or both plants, used <br />ol rcsif!3nLial structures u-ithin <br />the UDU Franchise area as defined and if capacity allows not <br />-4- <br />LAW OFFICES OF BURCH.
