N <br />CHAIRMAN SIEBERT ASKED IF ANYONE PRESENT WISHED TO BE HEARD. <br />ATTORNEY .JERRY KRAMER APPEARED REPRESENTING THE VERO BEACH <br />CIVIC ASSOCIATION,, AND NOTED THAT THE PROPOSED ORDINANCE TO DESIGNATE THE <br />COUNTY ZONING COMMISSION AS ITS LOCAL PLANNING AGENCY IS MERELY A <br />MECHANICAL ORDINANCE TO COMPLY WITH THE COMPREHENSIVE PLANNING ACT. HE <br />INVITED THE BOARD'S ATTENTION TO THE FACT THAT SECTION 8 OF THE ACT <br />CALLS FOR PUBLIC PARTICIPATION IN THE COMPREHENSIVE PLANNING PROCESSES <br />AND DUE PUBLIC NOTICE. HE NOTED IT SAYS THE GOVERNING BODY SHALL DO <br />THIS, BUT BASICALLY THE COUNTY IS, IN EFFECT, DELEGATING THE REQUIREMENTS <br />{� l <br />OF THAT SECTION TO THE ZONING COMMISSION. MR. KRAMER SUGGESTED THAT <br />i <br />A SECTION BE INSERTED BETWEEN SECTIONS 6 AND % OF THE PROPOSED ORDINANCE <br />PROVIDING' THAT THE REQUIREMENTS OF SECTION S OF THE COMPREHENSIVE <br />PLANNING ACT BE DELEGATED TO THE ZONING COMMISSION. HE ALSO SUGGESTED THE <br />WORDS "GOVERNING BODY" BE CHANGED TO READ "ZONING COMMISSION.` <br />ATTORNEY COLLINS POINTED OUT THAT THE RESPONSIBILITY FOR <br />COMPLIANCE WITH THE STATUTE RESTS WITH THE DIRECTORS OF THE DELEGATED BODY. <br />HE ALSO NOTED THAT THE PROPOSED ORDINANCE IS PREPARED ACCORDING TO RECOM— <br />MENDED GUIDELINES BY THE STATE OF FLORIDA, AND IT PROVIDES THAT THERE <br />SHALL BE PUBLIC MEETINGS AND PUBLIC RECORDS, AND HE, THEREFORE, DOES <br />NOT FEEL IT IS NECESSARY TO INCLUDE THE CHANGES SUGGESTED BY MR, KRAMER. <br />ATTORNEY KRAMER CONTINUED THAT IF YOU DON'T MAKE SURE THAT THE <br />i� <br />LOCAL PLANNING AGENCY COMPLIES WITH SECTION S, YOU`ARE LEAVING YOURSELF <br />.OPEN TO AN ARGUMENT WHEN THEY COME TO YOU WITH A RECOMMENDATION AND SOME <br />MEMBER OF THE PUBLIC FEELS THAT THEY DID NOT RECEIVE ENOUGH INFORMATION. <br />DISCUSSION FOLLOWED, AND ATTORNEY COLLINS REITERATED THAT <br />HE FELT THE PROPOSED ORDINANCE COVERS THIS EVENTUALITY, <br />CHAIRMAN SIEBERT STATED THAT HE WOULD HAVE NO OBJECTION TO <br />HAVING THE MINUTES REFLECT THAT IT BE 'UNDERSTOOD BY THE INDIAN DIVER <br />ZONING COMMISSION THAT THEY ARE GOVERNED BY THE STATE COMPREHENSIVE <br />PLANNING ACT OF 1975 INCLUDING SECTION S THEREOF. <br />;; <br />10 <br />
