Section 3.04. OFFICE OF COUNTY ATPORNEY. <br />-There shall be the office of County Attorney,- the head of which shall be the <br />Cc mty Attorney. The County Attorney shall be the chief legal officer of the County <br />u;ho a„n-11 be appointed by the Camtiissicn. He shall represent the County, the Commission <br />the 61e . 1• County officers, the Administrator and all departments, offices and agencies <br />of the Coumty in all legal matters affecting their official duties. If the County At- <br />torney certifies that he has a conflict*of interest in the performance of his duties., <br />then he shall certify uii.ch agency of the County he will represent, if any, and the <br />other agency or agencies may engage other counsel to represent them. Such other coun- <br />sel shall be allowed reasonable compensation by the Commission. The County Attorney, <br />may, subject to the approval of the Commission, appoint assistant county attorneys and <br />engage the services of special counsel.. The Canty Attorney and all assistant county <br />attorneys shall be licensed to practice lana in the State of Florida and shall not other- <br />wise engage in the practice of law. Each shall serve an indefinite term which can be <br />terminated by the Commission after sixty (60) days' notice or immediately with sixty <br />(60) days' severance pay. <br />ARTICLE IV <br />1: 'll M' 1 �1' • '�1 !� �) M • II • HSI 1 . <br />Section 4.01. CUOtAL PROVISIONS. <br />A. The activities under the direction and supervision of the Administrator shall <br />be distributed among the initial departments established by this Charter or among those <br />that may be established by the Organizational Ordinance. <br />B. Each department shall be admmi_stered by the Administrator or by an officer <br />appointed by him and subject under the Charter to his direction and supervision. The <br />appointment of the department heads shall be subject to the. approval of the Commission. <br />Section 4.02. INITIAL DEPARTMENTS AMID OFFICES. <br />A. The following initial departments and offices are hereby established: <br />(1.) Department of Finance; <br />(2.) Department of Planning; <br />(3.) Departmeut of Central Services; <br />(4.) Department of Personnel; <br />(5.) Department of Transportation; <br />(6.) Department of Huunan Services; <br />(7.) Departlmeat of Data Processing; and <br />(8.) Former Nan -Charter Departments. <br />Section 4.03, DEPAPM4W OF FIWCE. <br />A. ?it: e slLail be a Department of Finance which shall be responsible for the <br />&-1-d. gist atim of the financial affairs of the County.. The services provided by the . <br />uepartment of Finance will be utilized by the elected County officers, the Administra- <br />tor, and all other agencies of the County established by this Charter or by County <br />ordinance. . <br />B. All fiscal functions and duties now prescribed by the Constitution and Laws <br />of Florida for the office of the Clerk of the Circuit Court which relate to the Clerk's <br />duties as the custodian of county funds and auditor are hereby transferred to the De- <br />partment of Finance. <br />-7- <br />
