RESOLUTION 2008-195 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR THE VACATION <br />OF TOWN OF BROADMOOR SUBDIVISION, SAID LAND LYING IN <br />INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, on October 16, 2008, 2006, Indian River County received a duly executed <br />and documented application from St. Johns River Water Management District (the "owner") <br />requesting that the County vacate the plat of the Town of Broadmoor subdivision recorded in <br />Plat Book 2, Page 23 of St. Lucie County, said lands now lying and being in Indian River <br />County, Florida; and <br />WHEREAS, in accordance with Florida Statutes 177.101, notice of the intent to apply for <br />plat vacation was duly published by the owner in two weekly issues of a newspaper of general <br />circulation in the county; and <br />WHEREAS, after consideration of the petition, supporting documents, staff investigation <br />and report, and testimony of all those interested and present, the Board finds that the applicant <br />owns the fee simple title to the Town of Broadmoor subdivision, including the roadways, parks <br />and alleys; and <br />WHEREAS, the Board further finds that vacation of the subdivision plat will not affect <br />the ownership or right of convenient access of persons owning other parts of the subdivision. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. The plat of Town of Broadmoor subdivision recorded in Plat Book 2, Page 23 of St. <br />Lucie County, now lying in Indian River County, Florida, is hereby vacated. (See Exhibit <br />"A", attached.) <br />2. The Clerk is hereby directed to record this resolution together with the proofs of <br />publication required by Florida Statutes 177.101 in the Official Record Books of Indian <br />River County without undue delay. <br />The foregoing resolution was offered by Commissioner Wheeler who moved <br />its adoption. The motion was seconded by Commissioner Flescher and upon being put <br />to a vote, the vote was as follows: <br />Chairman Wesley Davis <br />Vice Chairman Joseph E.
