<br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN
<br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING,
<br />ABANDONMENT, VACATION AND DISCONTINUANCE OF A SEGMENT OF
<br />46TH AVENUE (SUNRISE STREET) LYING BETWEEN CR510 AND 86111 PLACE
<br />AND LYING EAST OF AND ADJACENT TO BLOCK 8 WEONA PARK, AS
<br />SHOWN IN PLAT BOOK 2, PAGE 17 OF THE PUBLIC RECORDS OF INDIAN
<br />RIVER COUNTY, FLORIDA, AS DESCRIBED HEREIN, SAID LAND LYING IN
<br />INDIAN RIVER COUNTY, FLORIDA
<br />WHEREAS, on April 27, 2007, Indian River County received a duly executed and documented
<br />petition from James W. Davis, Public Works Director, requesting that the County close, vacate,
<br />abandon, discontinue, renounce and disclaim any right, title and interest of the County and the public in
<br />and to a segment of 46th Avenue (Sunrise Street) lying between CR510 and 86th Place and lying cast of
<br />and adjacent to Block 8 Weona Park, as shown in Plat Book 2, Page 17 of the Public Records of Indian
<br />River County, Florida, said lands now lying and being in Indian River County, Florida; and
<br />WHEREAS, in accordance with Florida Statutes 336. 10, notice of a public hearing to consider
<br />said petition was duly published; and
<br />WHEREAS, atter consideration of the petition, supporting documents, staff investigation and
<br />report, and testimony of all those interested and present, the Board finds that the subject right-of-way is
<br />not a state or federal highway, nor located within any municipality, nor is said right-of-way necessary
<br />for continuity of the County's street and thoroughfare network, nor access to any given private property.
<br />NOW, THEREFORE,
<br />BE IT

<br />COUNTY, FLORIDA

<br />A PARCEL OF LAND BEING A PORTION OF WEONA PARK ACCORDING TO
<br />THE PLAT THEREOF AS RECORDED IN PLAT BOOK 2, PAGE 17 OF THE
<br />PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA, SAID PARCEL
<br />BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS.
<br />BEGIN AT THE INTERSECTION OF THE WEST RIGHT OF WAY LINE OF 46TH
<br />AVENUE (SUNRISE STREET) AND THE SOUTH RIGHT OF WAY LINE OF
<br />86TH PLACE (HIBISCUS BOULEVARD) AS SHOWN ON THE PLAT OF
<br />WEONA PARK AS RECORDED IN PLAT BOOK 2, PAGE 17, OF THE PUBLIC
<br />RECORDS OF ST. LUCIE COUNTY (NOW INDIAN RIVER) COUNTY, FLORIDA
<br />SAID POINT ALSO BEING THE NORTHEAST CORNER OF LOT 13, BLOCK 8,
