SEP 2 2 1976 - <br />As all parties are aware, the County has not gone into <br />an active water program and I find it very hard to believe <br />that the area referred to in this Annex should. be charged <br />against Indian River County's allocation until such time as <br />the County in fact either services the area or is capable <br />of taking over the service in the.area. <br />F. Continuing on in Annex 1, paragraph 5, page 4, <br />Plant capacities reserved for the County. Section B says: <br />"After completion of the plant capacity of 29.0 MGD's <br />capacity 1.3 million gallons per day at a maximum flow <br />rate of 900 gallons per minute at 5 PSI or more pressure." <br />This paragraph applies to the allocation and it's an <br />allocation to be made after the date the Agreement is signed. <br />Obviously -the present consumption areas were served by the <br />City of Vero Beach prior to that date and it is difficult to <br />believe that the allocation was tj be applied retroactively. <br />Certainly nowhere in the Agreement is that provision to be <br />found. <br />C. The County Commissioners who were involved during <br />the negotiations all indicated that at no time was *he <br />matter of present consumption uses brought up as to a <br />reduction of the County's allocation. The Agreements that <br />I have referred to above do not refer to such a reduction, <br />and, in fact, by the terminology quoted, indicate that that <br />is not the case. <br />In summary, it is Indian River County's position that ' <br />they cannot allocate any additional reserve until this matter <br />is settled. As you are aware the County has many requests <br />for water service by parties who potentially will provide <br />a public service to the County as a whole. These requests <br />include shopping centers and medical offices for the new <br />Indian River Memorial Hospital. For the purposes of <br />negotiation Mr. Lloyd's peak figures have been used and <br />by our calculation presently 5000,000 gallons per day have <br />.been allocated to Indian River Memorial Hospital, 31,500 <br />gallons per day to Indian River Community College, and <br />374,400 gallons per day to Urban Development Utilities. <br />By my calculations, Indian River County has allocated <br />905,900 gallons per day as of to s date. There should, <br />therefore, be left 394,100 gallons per day to be allocated. <br />The Indian River County Commissioners will be meeting <br />on Wednesday, the 22nd. On their Agenda is•a request for <br />water allocation for doctors° offices at the Hospital. The <br />Commissioners must know the City's position before making <br />any decisions. I, therefore, request you notify me on <br />Wednesday morning of the City's resolution of this matter; <br />thereafter, the County will take.appropriate action. <br />Thank you for your consideration in this matter. <br />Sincerely, <br />GEORGE G.
