Jennings September 15, 1976 s� <br />County Administrator <br />Indian River County <br />Vero Beach, Florida 32960 <br />RT: Urban Development Utilities, Inc. <br />e - <br />Dear Mr. Jennings: <br />This is in reply to your letter of September 9, 1976, regarding the Cur- <br />rent status of the proposed improvements to the water system of Urban <br />Development Utilities, Inc. <br />on February 18, 1976, in a letter addressed to you we enclosed the original <br />and one copy of the Water Purchase Agreement between Indian River County <br />and Urban Development Utilities, Inc., which I had executed. lie are enclos- <br />Ing a copy of our letter of February 18, 1976, and a copy of the Agreement <br />In the event that you did not receive them. <br />We are also enclosing a copy of the subordination by the Government which <br />has been executed by Urban Development Utilities, Inc., the Board of <br />County Commissioners of Indian River County, and me. <br />The final plans and specifications have been approved for the water system's <br />Improvements by the State Department of Environment Regulation and this <br />office. Prior to advertising for construction bids, the following must <br />be accomplished: <br />1. The legal work relative to preliminary title opinion and <br />-- easements and rights-of-way presently owned by Urban Development <br />Utilities, Inc., and to be acquired must be completed by <br />Mr. Charles L. Herring, Attorney for the Association. <br />2. The Board of County Commissioners of Indian River. County must <br />approve water rate increase. It is our understanding the Com- <br />mission is reluctant to approve the required increase prior to <br />the completion of the planed improvements. Since the increase <br />In user rates must be approved prior to commencing construction, <br />we impose no objection tovthe Commission approving the rate t <br />increase with the stipulation that increased rates will not become <br />effective until 15 days from the date final approval of the water - <br />system has been made by the State Department of Environmental <br />Regulation. <br />- 17 <br />SEP 2 21976 <br />eon 26 � A 080 <br />
