RESOLUTION NO. 2005- 168 <br /> A RESOLUTION OF INDIAN RIVER COUNTY,FLORIDA,RELEASING <br /> A CONSERVATION EASEMENT ON LOT 4,BLOCK D,LINDSEY LANES SUB <br /> PHASE I <br /> WHEREAS,Indian River County has an interest in a conservation easement on Lot 4,Block D, <br /> of Lindsey Lanes Phase I Subdivision; and <br /> WHEREAS,the owners of the lot have paid the County a fee-in-lieu of native upland set-aside, in <br /> accordance with Section 929.05 of the Code of Laws and Ordinances of Indian River County; and <br /> WHEREAS, Indian River County has released similar conservation easements on platted lots in <br /> Lindsey Lanes Phase I Subdivision for fees-in-lieu of on-site native upland plant community <br /> conservation, and release of the subject easement is consistent with past easement releases in the <br /> Subdivision; <br /> NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Indian <br /> River County,Florida that: <br /> LJ Indian River County does hereby release and abandon all right, title, and interest that it may have in <br /> CJ the following described easement(s): <br /> U_ 0) <br /> U_ 1- co the east twenty(20)foot-wide conservation easement of-Lot 4, Block D, Lindsey Lanes Phase I <br /> UQ Subdivision, according to the plat thereof recorded in Plat Book 13, Page 67 of the Public Records of <br /> X -0 Indian River County, Florida. <br /> W F- Ir <br /> CO <br /> JO This release of easement is executed by Indian River County, a political subdivision of the State of <br /> p LoFlorida,whose mailing address is 1840 25th Street,Vero Beach,Florida 32960, Grantor, to <br /> N <br /> f-- = <br /> L¢ o Q ROBERT BLAKE SCHMALENBERGER <br /> "t Lu &MARTHA CREWS SCHMALENBERGER <br /> 0 4830 49TH AVE <br /> pC VERO BEACH, FL 32967 <br /> O W <br /> CJ their successors in interest, heirs and assigns, as Grantee. <br /> THIS RESOLUTION was moved for adoption by Commissioner Neuberger , seconded by <br /> Commissioner Davis , and adopted on the 11 th day of <br /> October 2005,by the following vote: <br /> Chairman Thomas S.
