RESOLUTION NO. 2003 - 159 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, RELEASING <br />THE COUNTY'S EASEMENT INTEREST IN A PORTION OF CHARLESTON <br />DRIVE, A PRIVATE RIGHT-OF-WAY, ADJACENT TO LOT 6, BLOCK 6, <br />WINDSOR PD PHASE I <br />WHEREAS, Indian River County has an easement interest in Charleston Drive, a private <br />right-of-way in Windsor Planned Development (PD) Phase I; and <br />WHEREAS, the retention of a portion of the easement interest, as described below, serves no public <br />purpose; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian <br />River County, Florida that: <br />This release of easement interest is executed by Indian River County, a political subdivision of the <br />State of Florida, whose mailing address is 1840 25th Street, Vero Beach, Honda 32960, Grantor, to <br />WINDSOR COMMUNITY ASSOCIATION, INC. <br />3125 WINDSOR BLVD. <br />VERO BEACH FL 32963 <br />its successors in interest, heirs and assigns, as Grantee, as follows: <br />Indian River County does hereby release and abandon all right, title, and interest that it may <br />have in the following described easement(s) <br />A PORTION OF CHARLESTON DRIVE RIGHT-OF-WAY/EASEMENT OF WINDSOR PLAT 1 PD RECORDED IN <br />PLAT BOOK 13 PAGE 51, PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA, SAID PORTION MORE <br />PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCE AT THE POINT OF CURVATURE ON THE WEST <br />RIGHT-OF-WAY LINE OF CHARLESTON DRIVE (A 48' RIGHT-OF-WAY) AND ALSO BEING THE EAST LINE OF LOT 5, <br />BLOCK 6, OF AFORESAID WINDSOR PLAT 1 PD, SAID POINT ALSO BEING THE BEGINNING OF A CURVE, CONCAVE <br />TO THE NORTHEAST, THE RADIUS OF WHICH BEARS NORTH 83 DEG 25 MIN 38 SEC EAST A DISTANCE OF 250.73 <br />FEET; THENCE RUN SOUTHERLY ALONG THE ARC OF SAID CURVE, THROUGHA CENTRAL ANGLE OF 05 DEG 13 <br />MIN 58 SEC, AN ARC DISTANCE OF 22.90 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTHERLY <br />ALONG SAID ARC THROUGHA CENTRAL ANGLE OF 14 DEG 41 MIN 48 SEC, AN ARC DISTANCE OF 64.31 FEET TO <br />THE NORTHEAST CORNER OF LOT 7, BLOCK 6, OF AFORESAID WINDSOR PLAT 1 PD; THENCE RUN NORTH 19 DEG <br />08 MIN 56 SEC WEST, A DISTANCE OF 64.14 FEET TO THE POINT OF BEGINNING. <br />THIS RESOLUTION was moved for adoption by Commissioner Adams <br />Commissioner Gi nn and adopted on the 9th day of <br />December 2003, by the following vote: <br />Commissioner Kenneth R.
