a ® � <br />CHAIRMAN SIEBERT STATED HE FELT POSSIBLY SOME HIGHER RATE MIGHT <br />BE JUSTIFIED, BUT FELT IT WOULD BE IMPROPER FOR THE BOARD TO HEAR IT AT <br />THIS POINT AS TROPIC GROVES IS NOT THE CURRENT FRANCHISE HOLDER, THE <br />CHAIRMAN ASKED ATTORNEY COLLINS FOR HIS LEGAL OPINION ON THIS POINT, <br />ATTORNEY COLLINS STATED THAT THIS IS THE RELINQUISHMENT OF A <br />FRANCHISE FOR WHICH THERE NEVER WERE ANY RATES ESTABLISHED AND THE BOARD'S <br />FUNCTION -IS TO ISSUE A FRANCHISE AND SET RATES, <br />IN DISCUSSION IT WAS FELT THAT THIS IS A UNIQUE SITUATION AS A <br />FRANCHISE IS USUALLY ISSUED ON AN UNDEVELOPED AREA, <br />MRS, EUGENE LUIPPOLD, A CONDOMINIUM OWNER, APPEARED AND STATED <br />SHE REALIZES THAT THE OWNERS ARE LOSING MONEY, BUT SHE DOES NOT FEEL THE <br />CONDOMINIUM OWNERS SHOULD ASSUME A 200% INCREASE FOR SOMETHING THEY ARE <br />NOT GOING TO BENEFIT FROM. SHE ALSO NOTED THAT SHE FELT THEY WERE <br />ASSUMING IN THEIR MONTHLY MAINTENANCE FEE EXPENSES THAT SHOULD BE BORNE <br />BY THE CORPORATION, SUCH AS CUTTING OF THE GRASS AROUND THE PLANT, ETC, <br />ADMINISTRATOR JENNINGS INFORMED THE BOARD THAT HE HAD A REQUEST <br />FROM AN OWNER OF NEARBY PROPERTY, WILLIAM ORTH, THAT IT BE PLACED IN THE <br />RECORDS THAT HE HAS A PROBLEM BECAUSE OF A DRAINAGE DITCH THAT IS BEING <br />BLOCKED BY THIS DEVELOPMENT, <br />COMMISSIONER Loy STATED THAT SHE WOULD LIKE TO GET THE FRANCHISE <br />STRAIGHTENED OUT AND WOULD LIKE TO ESTABLISH RATES, BUT WITH THE INFORM- <br />ATION PRESENTED TODAY, SHE WOULD NOT BE IN FAVOR OF ADOPTING ANY <br />RESOLUTION SUPPORTING THE RATES PROPOSED, SHE NOTED THAT THE RATES WOULD <br />BE AN INCREASE OF OVER 2000 FOR PEOPLE WHO DO NOT REALLY REQUIRE ANY <br />MORE SERVICE. <br />MR. LEUTHJE STATED THAT HE WOULD BE GLAD TO SUPPLY ANY INFORMATION <br />IN THE WAY OF COST FIGURES AND HAVE THEM CERTIFIED AND MAKE ANOTHER <br />PRESENTATION AND ASKEDIIF THEY COULD JUSTIFY A 200% INCREASE, WOULD THE <br />BOARD CONSIDER IT, <br />IT WAS FELT A 200/ INCREASE WOULD BE VERY HARD TO JUSTIFY, <br />CHAIRMAN SIEBERT NOTED THAT ANY TIME YOU DEVELOP PROPERTY YOU <br />ARE TAKING A RISK, AND HE DID NOT FEEL THE PEOPLE SHOULD BE PENALIZAED <br />BECAUSE THE PROPERTY WAS NOT FULLY DEVELOPED, <br />COMMISSIONER WODTKE DISCUSSED THE UNIQUE ASPECT OF THIS PARTICULAR <br />FRANCHISE AND HOPED SOMETHING COULD BE WORKED OUT TO SHIFT SOME OF THE <br />COST BURDEN ONTO THE NEW CONSTRUCTION ANGLE, <br />57 <br />OCT 2 0197 Boot 27 137 <br />
