II <br />RESOLUTION NO.Q,j� <br />A RESOLUTION AUTHORIZING AND DIRECTING THE PROPER <br />CITY OFFICIALS TO EXECUTE ON BEHALF OF THE CITY AN <br />AGREEMENT WITH THE COUNTY OF INDIAN RIVER PROVIDING <br />FOR THE RELOCATION OF UTILITY STRUCTURES LOCATED <br />ABOVE GROUND AND IN THE INFRASTRUCTURES OF A PARCEL <br />OF LAND OWNED BY THE CITY OF VERO BEACH WHICH IS 100 <br />FEET IN WIDTH AND RUNNING EAST AND WEST BETWEEN THE <br />INTERSECTION OF INDIAN RIVER BOULEVARD AT 17TH STREET <br />AND THE WEST BANK OF THE INDIAN RIVER, THE CENTERLINE <br />OF WHICH IS AN EXTENSION OF THE CENTERLINE OF 17TH <br />STREET; SAID PARCEL TO BE CONVEYED TO THE DEPARTMENT <br />OF TRANSPORTATION FOR USE IN THE PROPOSED CONSTRUC- <br />TION OF THE 17TH STREET BRIDGE. <br />L <br />WHEREAS, the State of Florida through its Department of Transportation, <br />hereinafter referred to as "DOT", has formulated plans for the construction of a <br />Bridge in the CITY crossing the Indian River between 17th Street on the West and <br />Causeway Boulevard on the East; and, <br />WHEREAS, there has been a judicial determination that the CITY owns <br />fee simple title to a one hundred (100) foot wide strip of land running bet -len <br />the intersection of 17th Street and Indian River Boulevard and the Westerly bank <br />of the Indian River, which strip is more specifically described hereinafter, <br />and referred to as "THE CORRIDOR", and which strip of land is necessary for the <br />Westerly approach of said proposed bridge; and, <br />WHEREAS, the CITY has.heretofore constructed in "THE CORRIDOR" elec- <br />tric lines and water and sewer lines and pipes referred to hereinafter as <br />"UTILITIES", some of which must be relocated to allow bridge construction; and, <br />WHEREAS, the CITY has submitted to COUNTY the estimates for UTILITIES <br />relocation within THE CORRIDOR at an approximate cost of FOUR HUNDRED THREE <br />THOUSAND SIX HUNDRED DOLLARS ($403,600.00); and, <br />WHEREAS, although the question of responsibility for the costs of <br />relocation of said UTILITIES and other legal questions in regard to the 17th <br />Street Bridge Project are unresolved; the parties desire to enter into a <br />mutually acceptable Agreement which will facilitate the construction of said <br />Bridge the need for which is well established; and, <br />DEC 1976 p <br />err "7 :379 <br />
