<br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN
<br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING,
<br />ABANDONMENT, VACATION AND DISCONTINUANCE OF A PORTION OF
<br />13th STREET LYING BETWEEN 6th AVENUE AND 4th COURT, SAID LAND
<br />LYING IN INDIAN RIVER COUNTY, FLORIDA
<br />WHEREAS, on October 3, 2002, Indian River County received a duly executed and
<br />documented petition from Robert Lee of Sebastian, Florida, requesting that the County close, vacate,
<br />abandon, discontinue, renounce and disclaim any right, title and interest of the County and the public
<br />in and to a portion 13th Street lying between 6th Avenue and 4th Court as shown on the plat of the
<br />Orange Terrace subdivision and recorded in Plat Book 10, Page 17 of the public records of Indian
<br />River County, Florida , said lands lying in Indian River County, Florida; and
<br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to
<br />consider said petition was duly published; and
<br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and
<br />report, and testimony of all those interested and present, the board finds that the subject right-of-way
<br />is not a state or federal highway, nor located within any municipality, nor is said right-of-way
<br />necessary for continuity of the County's street and thoroughfare network, nor access to any given
<br />private property.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
<br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that:
<br />1. All right, title and interest of the County and the public in and to that certain right-of-way
<br />being known more particularly as:
<br />A PORTION OF STREET RIGHT OF WAY LYING IN THE SOUTHEAST 1/4 OF
<br />THE NORTHEAST 1/4 OF SECTION 12, TOWNSHIP 33 SOUTH, RANGE 39
<br />EAST, INDIAN RIVER COUNTY, FLORIDA, SAID PORTION BEING MORE
<br />PARTICULARLY DESCRIBED AS FOLLOWS;
<br />COMMENCING AT TIE SOUTHEAST CORNER OF LOT 12, ORANGE
<br />TERRACE SUBDIVISION, AS RECORDED IN PLAT BOOK 10, PAGE 17, OF
<br />THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA FOR THE
<br />POINT OF BEGINNING OF THE HEREIN DESCRIBED PORTION OF STREET
<br />RIGHT OF WAY, THENCE S00°08'00"W ALONG THE EAST LINE OF SAID
<br />LOT 12, ORANGE TERRACE SUBDIVISION, EXTENDED SOUTH, 30.00
<br />FEET, THENCE N89°42'40"W ALONG A LINE PARALLEL TO AND LYING
<br />30.00 FEET SOUTH OF THE SOUTH LINE OF LOTS 11 AND 12, OF SAID
<br />ORANGE TERRACE SUBDIVISION, 202.87 FEET TO A POINT LYING 30.00
<br />FEET SOUTH OF THE WEST LINE OF SAID LOT 11 EXTENDED, THENCE
<br />N00°04'30"W ALONG THE WEST LINE OF SAID LOT 11 EXTENDED, 30.00
<br />FEET TO THE SOUTHWEST CORNER OF SAID LOT 11, THENCE
