` 2/1(reso\annua1)Bk/jb <br /> RESOLUTION NO. 2001- 012 <br /> A RESOLUTION OF THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br /> SETTING YEAR-END GUIDELINES FOR FINANCIAL <br /> REPORTING AND PAYMENT BY COUNTY OFFICERS. <br /> WHEREAS, Section 218.36(1), Florida Statutes (2000), requires each county <br /> officer to submit an annual report of his or her fees, commissions, and remunerations, <br /> to the board of county commissioners within 31 days of the close of his or her fiscal <br /> year; and <br /> WHEREAS, Section 218.36(2), Florida Statutes (2000), requires each county <br /> officer to pay into the county general fund all money in excess of the sum to which he or <br /> she is entitled under chapter 145 on or before the date for filing the annual report; and <br /> WHEREAS, Section 218.36(3), Florida Statutes (2000), requires the board of <br /> county commissioners to notify the governor on the thirty-second day following the <br /> close of the fiscal year of the failure of a county officer to comply with the provisions of <br /> Section 218.36; and <br /> WHEREAS, there are times when, on or before the close of the fiscal year, due <br /> to disbursement schedules, a county officer is not in actual possession of grant money <br /> which has been approved and to which he or she is entitled; and <br /> WHEREAS, sound accounting principles recognize that accounts receivable in a <br /> fiscal year may not be received until after the close of the fiscal year, <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners <br /> of Indian River County, Florida, as follows: <br /> A county officer who, on or before the close of the fiscal year, due to disbursement <br /> schedules, is not in actual possession of grant money which has been approved and <br /> to which he or she is entitled, shall include such grant money in his or her report to <br /> the Board of County Commissioners in the fiscal year in which such grant is <br /> approved, showing documentation thereof, and shall pay into the county general <br /> fund any amount due pursuant to Section 218.36(2), Florida Statutes (2000), within <br /> thirty (30) days following the close of the fiscal year. In the event such county officer <br /> does not receive such funds within thirty (30) days following the close of the fiscal <br /> year such county officer shall nevertheless submit the annual report to the Board of <br /> County Commissioners before the thirty-first day following the close of the fiscal <br /> year. Included with the report shall be a statement of any funds not received by that <br /> date and a statement that such officer will submit those monies not more than seven <br /> (7) working days from the date of receipt of those monies. <br />
