ATTORNEY HENDERSON REPORTED THAT TREASURE COAST HAS NEGOTIATED <br />AND COORDINATED WITH THE DEPARTMENT OF ENVIRONMENTAL REGULATION IN REGARD <br />TO INSTALLATION OF THE SEWER PLANT, WHICH IS NOW IN THE PROCESS OF BEING <br />APPROVED BY THE DER, AND THEY ANTICIPATE THAT AFTER INSTALLATION, THE LAW- <br />SUIT BY THE DER WILL BE DISMISSED. <br />ATTORNEY HENDERSON POINTED OUT THAT THE ORIGINAL FRANCHISE HOOK- <br />UP CHAPIES FOR WATER AND SEWER WERE ESTABLISHED IN 1961, AND THE RATES <br />APPROVED AT THE TIME OF TRANSFER MADE NO MENTION OF CONNECTION CHARGES, <br />HE STATED THAT HE FELT THE PROPOSED HOOK-UP AND CONNECTION CHARGES OF <br />$350.00 FOR WATER AND $600.00 FOR SEWER REFLECT THE INFLATIONARY MOVEMENT <br />OVER THE YEARS AND ARE IN LINE WITH OTHER SYSTEMS IN THE COUNTY. THESE <br />CHARGES DO NOT AFFECT THOSE ALREADY CONNECTED TO THE SYSTEM. ATTORNEY <br />HENDERSON NOTED THAT THERE WAS NO MENTION OF A DEPOSIT FOR SEWER SERVICE <br />IN THE ORIGINAL FRANCHISE AS THERE WAS NO SEWER SERVICE AT THE TIME. <br />COMMISSIONER Loy INQUIRED HOW THEY ARRIVED AT A $600.00 CHARGE <br />FOR SEWER HOOK-UP. <br />LOWELL 10liMAN, PRESIDENT OF TREASURE COAST UTILITIES, INC., <br />STATED THAT IT IS A FIGURE THAT MOST PRIVATE UTILITY COMPANIES USE AND <br />NOTED THAT THEY WILL HAVE AN INVESTMENT OF ABOUT $40,0010 IN THE PLANT BY <br />THE TIME IT IS INSTALLED. <br />ATTORNEY HENDERSON STATED THAT THIS CHARGE IS INTENDED TO RECAP- <br />TURE PART OF THE CAPITAL INVESTMENT. <br />ADMINISTRATOR JENNINGS INFORMED THE BOARD THAT THESE PROPOSED <br />CHARGES ARE SLIGHTLY HIGHER THAN THOSE OF THE CITY OF VERO BEACH, BUT ARE <br />FAIRLY CLOSE TO OTHER FRANCHISES. <br />COMMISSIONER Loy AGREED THAT THE WATER HOOK-UP CHARGE IS SIMILAR <br />TO OTHER FRANCHISES, BUT NOTED THAT ONLY ONE OTHER FRANCHISE HAS A $600.00 <br />HOOK-UP CHARGE FOR SEWER AND SHE FELT IT MIGHT BE A LITTLE HIGH. <br />DISCUSSION CONTINUED WITH REGARD TO THE DEPOSITS TO BE REQUIRED, <br />AND MR. LOHMAN POINTED OUT THAT THEY HAVE AGREED TO PAY 6% ON THE DEPOSITS. <br />ATTORNEY COLLINS BROUGHT UP THE MATTER OF TREASURE COAST AGREE- <br />ING TO TURNOVER THEIR DISTRIBUTION LINES WHENEVER THE COUNTY GOES INTO <br />THE WATER BUSINESS. <br />ATTORNEY HENDERSON STATED THERE WOULD BE NO PROBLEM IN REGARD TO <br />THE DISTRIBUTION LINES, BUT THEY WOULD NOT BE AGREEABLE TO TURNING OVER <br />THE PLANT, <br />JAN 19 1977 <br />27 <br />� :-,A 323 <br />
