W <br />U <br />Q <br />a <br />Cn <br />-W- <br />C) <br />O w <br />J <br />Z U <br />O <br />Z <br />O Q <br />O <br />U U cc <br />wu a <br />=� m <br />oc <br />F- W Y <br />Q U <br />,L <br />N <br />�0Uj <br />CO LU ¢ <br />Co <br />LU I-- CC <br />Z Q <br />cc <br />4- � <br />6— N S <br />L4 <br />> ap M <br />}— r Q+ <br />Z cc <br />UJI <br />0 ? <br />8 <br />RESOLUTION 2007- 050 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE VACATION OF SUNRISE <br />SUBDIVISION, SAID LAND LYING IN INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, on November 9, 2006, Indian River County received a duly executed and <br />documented application from Sunrise Vero Beach, LLC (the "Developer") requesting that the <br />County vacate the plat of Sunrise subdivision recorded in Plat Book 20, Page 96 of Indian River <br />County, Florida, said lands now lying and being in Indian River County, Florida; and <br />WHEREAS, in accordance with Florida Statutes 177.101, notice of the intent to apply for <br />plat vacation was duly published by the Developer in two weekly issues of a newspaper of general <br />circulation in the county; and <br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and <br />report, and testimony of all those interested and present, the board finds that the Developer owns the <br />fee simple title to Sunrise subdivision excluding the rights-of-way dedicated to the public for 27th <br />Avenue SW and 15th Street SW; and <br />WHEREAS, the Board further finds that vacation of the subdivision plat excluding the <br />rights-of-way dedicated to the public. for 27th Avenue SW and 15th Street SW will not affect the <br />ownership or right of convenient access of persons owning other parts of the subdivision. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. The plat of Sunrise subdivision recorded in Plat Book 20, Page 96 of Indian River County, <br />Florida, is hereby vacated. (See Exhibit "A", attached.), <br />2. The Clerk is hereby directed to record this resoluto�ntogether wrththe proofs of publication <br />required by Florida Statutes 177.101 in s of Indian River County <br />without undue delay. .xr <br />Sunrise <br />th <br />3. The Contract for Construction of Required Improvements SD -03 -08 -21 -CFC and the <br />Contract for Construction of Required Sidewalk Improvements SD-03-08-21-CFCSIDE <br />between the County and the Developer are hereby cancelled, and each party is released from <br />any obligations there under. <br />The foregoing resolution was offered by Commissioner Davi s who moved its <br />adoption.
