SILVERMAN, doing business as Seminole <br />Shores Subdivision, hereinafter referred to as Parties of the <br />First Part, and INDIAN RIVER COUNTY, FLORIDA, a political sub- <br />division of the State of Florida, by and through its Board of <br />Countv Commissioners, hereinafter referred to as Party of the <br />Second Part; <br />W I T N E S S E. T H: <br />WHEREAS, the Parties of the First Part are the owners <br />of the following -described property located in Indian River <br />County, Florida, to -wit: <br />and <br />The North 330 feet West of State Road A -1-A of <br />Government Lot 4, Section 27, and the North 330 <br />feet East of Indian River of Government Lot 4, <br />Section 28, all in Township 33 South, Range 40 <br />East, <br />WHEREAS, the Parties of the First Part are desirous of <br />obtaining final plat approval for said property; and <br />WHEREAS, the Party of the Second Part requires that the <br />Parties of the First Part complete construction of a water <br />treatment plant and system on said property within one (1) year <br />from the date of the proposed final plat approval; and <br />WHEREAS, the Party of the Second Part requires that the <br />Parties of the First Part present a performance bond guarantee <br />the completion of said water treatment plant and system within <br />the said one-year period; <br />NOW, THEREFORE, for and in consideration of the mutual <br />covenants and conditions hereinafter contained, the parties h <br />do hereby agree as follows: <br />1. That the Parties of the First Part will completely <br />construct a water treatment plant and system on the above- <br />described property in accordance with the plans and specifica- <br />tions as set forth by the project engineer within one year from <br />the date of final plat approval by the Party of the Second Part. <br />2..
