<br />THIS INDENTURE made this day of
<br />. 1977, between INDIAN RIVER COUITTY M-DITAL DISTRICT, a
<br />i special taxing district created by Act of the Legislature,
<br />State of Florida, having its principal place of business in the
<br />City of Vero Beach, County of Indian River, State of Florida,
<br />as party of the first part, and the STATE OF FLORIDA, for the
<br />use and benefit of the State of Florida Department of Trans-
<br />portation, as party of the second part.
<br />WITNESSETH: That the party of the first part, for and -in-
<br />consideration of the sum of One Dollar ($1.00 and other valuable
<br />considerations, paid, receipt of which is hereby acknowledged,
<br />has granted, bargained, sold and conveyed and does hereby grant,
<br />!,bargain, sell and convey to the party of the second part, its
<br />'!successors and assigns forever, the following described land,
<br />;,situate,. lying and being in the County of Indian River, State
<br />,of Florida, to -wit:

<br />The Northerly 55.00 feet of the NW 1/4 of Section 36,
<br />Township 32 South, Range 39 East, IndiUn River County,.
<br />Florida.
<br />Containing 145,329 square feet or 3.3363 acres, more or less.
<br />All as shown on the Right of Way Map for Section 88511-2601,
<br />Barber Avenue, Indian River County.
<br />SUBJECT however to the following conditions:
<br />1. The property conveyed herein shall be used for
<br />road right-of-way purposes and no other purposes.
<br />2. Grantee shall complete construction of Barber
<br />Avenue, in its entirety and including turnouts to
<br />Grantors property, within three (3) years of the
<br />date of this conveyance, in accordance with the
<br />tentative plans and specifications prepared by
<br />Grantee, dated November 4, 1976, or in accordance
<br />with such modifications thereof as are approved by
<br />the Grantor in writing.
<br />In the event of breach by the Grantee of any of j!
<br />the aforementioned conditions subsequent, Grantor ! }
<br />t shall have the right to re-enter and repossess the
<br />subject property and to terminate the estate conveyed. 'f
