RESOLUTION 2014- 0 5 6 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, DESIGNATING 50TH AVENUE FROM 87TH <br />STREET TO US 1 AS A "COMMERCIAL SERVICE STREET", SAID LAND <br />LYING IN THE UNINCORPORATED AREA OF INDIAN RIVER COUNTY, <br />FLORIDA <br />WHEREAS, on April 15, 2014, the Indian River County Board of County Commissioners <br />heard a request from staff and the owners of a property at the northwest corner of US 1 and 87th <br />Street requesting that the Board recognize the special characteristics of a certain segment of 50th <br />Avenue and abutting properties and authorize staff to initiate an amendment to the land development <br />regulations (LDRs) to provide a definition for the segment of 50th Avenue that lies between 871h <br />Street and US 1; and <br />WHEREAS, staff drafted an ordinance defining a "Commercial Service Street" and <br />specifying appropriate yard designations for properties that abut a Commercial Service Street; and <br />WHEREAS, on May 22, 2014, the Planning &Zoning Commission held an advertised public <br />hearing to consider the Commercial Service Street ordinance and unanimously recommended that the <br />Board of County Commissioners adopt the ordinance; and <br />WHEREAS, on June 17, 2014, the Board of County Commissioners held an advertised <br />public hearing to consider the ordinance and adopted the ordinance; and <br />WHEREAS, the Board further finds that the subject segment of 50th Avenue roadway meets <br />all ordinance criteria for a Commercial Service Street by having limited right-of-way width (30' — <br />40'), serving only commercially zoned properties, and functioning as an alley or secondary access for <br />property that fronts the Commercial Service Street and an arterial street (US 1). <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that the segment of SOt" Avenue <br />from 87th Street to US 1 is hereby designated as a "Commercial Service Street", with the effective <br />date of this designation being the effective date of the "Commercial Service Street" ordinance. <br />The foregoing resolution was offered by Commissioner Solari <br />who moved its <br />adoption. I he motion was seconded by Commissioner na jj; G ,and upon being put to a <br />vote, the vote was as follows: <br />Chairman Peter D. O'Bryan <br />Vice Chairman Wesley S.
