3120130076497 <br />RECORDED IN THE PUBLIC RECORDS OF <br />JEFFREY R SMITH, CLERK OF COURT <br />INDIAN RIVER COUNTY FL <br />BK: 2722 PG: 1270 Page 1 of 3 12/6/2013 4:32 PM <br />RESOLUTION NO. 2013- 128 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, PROVIDING FOR THE RECOVERY OF <br />DEMOLITION COSTS. <br />WHEREAS, Indian River County has adopted the Property <br />Maintenance Code at Section 403, Indian River County Code; and <br />WHEREAS, Section 403.08 of the Property Maintenance Code <br />provides for the recovery of the costs of repairs to and/or demolitions of unsafe <br />structures; and <br />WHEREAS, Section 100.080 of the Indian River County Code <br />provides that the Board of County Commissioners may cause, by resolution, a <br />lien to be filed in the Official Record Books of the County against the property for <br />the costs incurred by the County; and <br />WHEREAS, pursuant to Chapter 162, F.S., notice of intent to adopt <br />a lien resolution was given to the property owner on January 15, 2013 by <br />certified mail; and <br />WHEREAS, on February 5, 2013 a lien resolution was brought <br />before the Board of County Commissioners for passage, but instead the property <br />owner was given a 30 -day stay to afford the property owner's son the opportunity <br />to perform due diligence, with input from an engineer, and to obtain a building <br />permit for rehabilitation of the property with the understanding that the structure <br />would be demolished if the required actions were not done within the 30 -day <br />stay; and <br />WHEREAS, the 30 -day extension passed, no building permit was <br />obtained for the property in question, and the demolition of the structure was <br />procured, <br />t <br />
