�: County Attorney <br />Approved as to Form and Legal Sufficiency <br />RESOLUTION NO, 2013=008 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION AUTHORIZING THE <br />CHAIRMAN'S EXECUTION OF A PERPETUAL EASEMENT FOR CONSTRUCTION OF A <br />BRIDGE OVER OLD DIXIE HIGHWAY AND THE RAILROAD TRACKS ALONG US HIGHWAY <br />1 AT THE SOUTH COUNTY LINE. <br />WHEREAS, the construction of the bridge over Old Dixie Highway and the railroad tracks along <br />US Highway 1 at the South County line is part of a Florida Department of Transportation project to <br />widen and improve State Road No. 5 (US Highway 1); and <br />WHEREAS, the Florida Department of Transportation (FDOT) is planning, designing and <br />constructing the bridge and roadway improvement project; and <br />WHEREAS, the State of Florida, Department of Transportation, has requested Indian River <br />County to execute and deliver to the State of Florida, Department of Transportation, a Perpetual <br />Easement for the aforementioned project; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, that the Chairman of the Board is hereby authorized to make, execute, and deliver <br />to the State of Florida, Department of Transportation, a Perpetual Easement for the aforementioned <br />project. <br />The foregoing resolution was offered by Commissioner Davis who moved <br />its adoption. The motion was seconded by Commissioner O'Bryan and, upon being put to a <br />vote, the vote was as follows. <br />Chairman Joseph E. Flescher <br />Vice -Chairman Wesley S.
