RESOLUTION NO. 2013- 078 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, AUTHORIZING THE CHAIRMAN'S EXECUTION OF A MODIFIED <br />PERPETUAL EASEMENT TO THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR <br />CONSTRUCTION OF A BRIDGE OVER OLD DIXIE HIGHWAY AND THE RAILROAD TRACKS <br />ALONG US HIGHWAY 1 AT THE SOUTH COUNTY LINE. <br />WHEREAS, the construction of the bridge over Old Dixie Highway and the railroad tracks along <br />US Highway 1 at the South County line is part of a Florida Department of Transportation project to <br />widen and improve State Road No. 5 (US Highway 1); and <br />WHEREAS, the Florida Department of Transportation (FDOT) is planning, designing and <br />constructing the bridge and roadway improvement project; and <br />WHEREAS, the State of Florida, Department of Transportation, has requested Indian River <br />County to execute and deliver to the State of Florida, Department of Transportation, a Modified <br />Perpetual Easement for the aforementioned project correcting an erroneous legal description on <br />the Perpetual Easement recorded at Official Record Book 2653, Page 192 of the Public Records of <br />Indian River County, Florida; and <br />WHEREAS, this resolution modifies, replaces and supersedes Resolution 2013-008. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, that the Chairman of the Board is hereby authorized to make, execute, and deliver <br />to the State of Florida, Department of Transportation, a Modified Perpetual Easement for the <br />aforementioned project. <br />The foregoing resolution was offered by Commissioner Solari who moved <br />its adoption. The motion was seconded by Commissioner Davis and, upon being put to a <br />vote, the vote was as follows: <br />Chairman Joseph E. Flescher Aye <br />Vice -Chairman Wesley S.
