. 4 <br /> RESOLUTION NO. 2012 - 032 <br /> A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br /> INDIAN RIVER COUNTY, FLORIDA, IN SUPPORT OF THE RIGHT OF <br /> CITIZENS IN INDIAN RIVER COUNTY AND SURROUNDING AREAS <br /> TO OPT OUT OF FLORIDA POWER & LIGHT'S SMART METER <br /> PROGRAM <br /> WHEREAS, as a result of certain orders of the Florida Public Service Commission and a <br /> franchise granted by the Indian River County Board of County Commissioners ("Board") <br /> Florida Power & Light ("FPL") has a monopoly to provide electric service to most areas of <br /> Indian River County; and <br /> WHEREAS, FPL is in the process of implementing its Automated Metering <br /> Infrastructure program, generally known as the "smart meter" program, in Indian River County; <br /> and <br /> WHEREAS, the Board is mindful that, pursuant to section 366.04(1), Florida Statutes, <br /> authority to regulate and supervise the smart meter program is vested solely in the Florida Public <br /> Service Commission; and <br /> WHEREAS, through several public meetings at which smart meters have been <br /> discussed, the Board has become acutely aware of the strongly held, good faith beliefs of certain <br /> citizens in Indian River County and surrounding areas that smart meters present health, safety, <br /> privacy and financial concerns; and <br /> WHEREAS, while the Board takes no position on the validity or non-validity of such <br /> concerns, the Board strongly believes that, given FPL's monopoly to provide electric service not <br /> only in most areas of Indian River County, but also throughout the rest of FPL's service area, <br /> citizens should not be forced to accept smart meters against their will and strongly held, good <br /> faith beliefs; and <br /> WHEREAS, accordingly, the Board has adopted this resolution urging FPL to <br /> implement, and the Florida Public Service Commission to require, that citizens opposing smart <br /> meters be given the freedom of choice to opt out of the smart meter program, without risk or <br /> threat of negative reprisals or other consequences, <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA THAT: <br /> 1. Recitals. The above recitals are incorporated as the findings of the Board. <br /> 2. Opt Out of Smart Meter Program.
