RESOLUTION NO. 2012-070 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, PROPOSING TO ACQUIRE STATE-OWNED <br />LANDS FROM THE BOARD OF TRUSTEES OF THE <br />INTERNAL IMPROVEMENT TRUST FUND <br />WHEREAS, the Indian River Correctional Institution formally operated on real property <br />located in Indian River County, Florida ("Subject Property"); and <br />WHEREAS on July 25, 2012, the Board of County Commissioners of Indian River <br />County ("Board of County Commissioners") received written notice from the Florida <br />Department of Environmental Protection Bureau of Public Land Administration, Division of <br />State Lands ("State of Florida") notifying the Board of County Commissioners of the availability <br />of the Subject Property, pursuant to §253.034(6)(f) and §253.111 Florida Statutes. A copy of <br />the notice, describing the Subject Property in greater detail, is attached hereto as Exhibit A; and <br />WHEREAS as set forth in the written notice, and pursuant to §253.111, Florida Statutes, <br />the Board of County Commissioners has adopted this Resolution proposing to purchase the <br />Subject Property, subject to the results of a real estate appraisal and such other terms and <br />conditions as the State of Florida determines and the Board of County Commissioners agrees, <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA: <br />Section 1. This Resolution shall serve as a formal notice from the Board of County <br />Commissioners to the State of Florida that it proposes to purchase the Subject Property from the <br />Board of Trustees of the Internal Improvement Trust Fund, subject to the results of a real estate <br />appraisal and such other terms and conditions as the State of Florida determines and the Board of <br />County Commissioners agrees. <br />Section 2 This Resolution shall also serve as a written commitment that the Board of <br />County Commissioners will pay the cost of an appraisal of the Subject Property, conducted in <br />accordance with the standards and requirements of §253.111(3), Florida Statutes. <br />Section 3 A certified copy of this Resolution shall be provided forthwith to the State of <br />Florida. <br />Section 4 This Resolution shall take effect immediately upon its adoption. <br />Page 1 of 2 <br />
