1 <br />ASSISTANT PLANNER BOB BERG DISPLAYED AERIAL OF THIS PRO <br />PERTY WHICH IS LOCATED ON SOUTH BEACH BETWEEN STATE ROAD AIA AND REEF <br />ROAD. HE STATED THAT IT IS LOCATED NEAR THE BILLOWS AND CONTAINS <br />` APPROXIMATELY 6.5 ACRES. MR. BERG INFORMED THE BOARD THAT THE COMPRE- <br />HENSIVE PLAN 'SHOWS THIS AREA TO BE IN MEDIUM DENSITY RATHER THAN <br />COMMERCIAL, AND THE REQUEST FOR REZONING TO R-ZC IS IN LINE WITH THE' <br />PLAN. HE NOTED THAT THE APPLICANTISTATES HE HAS A CONTRACT RESTRICT- <br />ING HIM TO NO MORE THAM 10 UNITS PER ACRES, AND THIS IS LESS THAN <br />THE DENSITY OUTLINED ON THE MASTER PLAN. MR. BERG CONTINUED THAT <br />MR. LACH CHANGED HIS REQUEST FROM R-3 TO R-2C�WHICH PERMITS A MAXIMUM <br />OF 12 UNITS PER ACRE,AT THE REQUEST OF PROPERTY OWNERS IN THE AREA <br />AS WELL AS THE ZONING COMMISSION. THE ZONING COMMISSION HAS UNANIMOUSLY <br />� APPROVED <br />THE AMENDED REQUEST. MR. BERG STATED THAT THERE ARE NO OB- <br />JECTIONS TO -THIS ZONING FROM ANY OF THE IMMEDIATE NEIGHBORS, AND THE <br />PLANNING STAFF RECOMMENDS APPROVAL ALSO, <br />THE CHAIRMAN ASKED IF ANYONE PRESENT WISHED TO BE HEARD. <br />RICHARD ALLEN, VICE PRESIDENT OF THE MOORINGS DEVELOPMENT <br />COMPANY, INFORMED THE BOARD THAT THEY CONVEYED THIS LAND TO <br />MR. LACH SUBJECT TO A DEED RESTRICTION WHICH DOES LIMIT THE DEVELOPER <br />TO 10 UNITS PER ACRE, AND THEY DO SUPPORT MR. LACHES REZONING REQUEST <br />AND APPROVE HIS PROPOSED DEVELOPMENT. <br />CARL WARD, VICE PRESIDENT OF THE BILLOWS, 1180 REEF ROAD, <br />STATED THAT WITH A RESTRICTION ON THE PROPERTY LIMITING IT TO 10 UNITS <br />PER ACRE, THE BILLOWS IS IN FAVOR'OF THE PROPOSED DEVELOPMENT. <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY CLOSED THE PUBLIC HEARING. <br />THE CHAIRMAN EXPLAINED TO THOSE PRESENT THAT ALTHOUGH THE <br />DEED RESTRICTION CALLS FOR 10 UNITS PER ACRE, THE PROPOSED ZONING, <br />IF APPROVED, WILL ALLOW 12 UNITS PER ACRE. <br />ON MOTION BY COMMISSIONER Loy, SECONDED BY COMMISSIONER <br />SCHMUCKER, THE BOARD UNANIMOUSLY ADOPTED ORDINANCE N0. 77-34 GRANTING <br />THE REZONING TO R -2C. <br />�O <br />SON <br />DEC 71977 J <br />
