t <br />y <br />ATTORNEY COLLINS COMMENTED THAT THE LEGAL NOTICE COMPLIES <br />WITH THE STATUTORY REQUIREMENTS, AND THE PROPERTY AS DESCRIBED IN <br />THE NOTICE IS, IN FACT, GREATER THAN THE REQUEST THAT WILL COME BEFORE <br />THE BOARD TODAY. HE STATED THAT BECAUSE THEY HAVE DESCRIBED NOT ONLY <br />THE PROPERTY REQUESTED. TO BE REZONED BUT ADDITIONAL PROPERTY, HE DOES <br />NOT FIND ANY DEFECT IN THE NOTICE. <br />ASSISTANT PLANNER BERG INFORMED THE BOARD THAT THE PROPERTY <br />IS LOCATED BETWEEN U.S. 1 AND RIVERSIDE DRIVE IMMEDIATELY NORTH OF THE <br />CITY LIMITS OF SEBASTIAN AND IS LOCATED IN AN AREA WHERE THE PLANNING <br />DEPARTMENT HAS RECENTLY MADE A STUDY. THIS PROPERTY IS ZONED C-1 AND R -Z. <br />THE ZONING TO THE EAST ALONG THE RIVER IS R-3 AND TO THE SOUTH R -IMP. <br />THE COMPREHENSIVE PLAN SHOWS MEDIUM DENSITY. THE APPLICANT IS RE- <br />QUESTING R -IA IN ORDER TO PUT IN A SUBDIVISION. MR. BERG NOTED THEIR <br />PLAN HAS NOT BEEN BEFORE THE SUBDIVISION REVIEW COMMITTEE YET, BUT <br />THE PROPOSED STREETS DO NOT ABUT ON U.S. I SO THERE WILL BE NO FRONTAGE <br />OF SINGLE FAMILY RESIDENCES ON U.S. 1. MR. BERG POINTED OUT THAT THIS <br />PARTICULAR SUBDIVISION WILL ALLOW SEPTIC TANKS, AND THE PLANNING STAFF <br />IS CONCERNED WITH THE POSSIBLE POLUTION OF CLASS II WATERS. HE NOTED <br />THAT THE ZONING COMMISSION RECOMMENDS APPROVAL OF R -IA. <br />THE CHAIRMAN ASKED IF ANYONE.WISHED TO BE HEARD. <br />E. M. SILVERSTEIN OF BAL HARBOR STATED THAT THIS REQUEST WAS <br />MADE FOR THE SIMPLE REASON THAT THERE IS NO DEMAND FOR 15 UNITS PER <br />ACRE OR ANY CONDOMINIUMS OR APARTMENTS. THE ONLY THING THAT CAN MOVE <br />IN"THIS PARTICULAR AREA IS SINGLE FAMILY HOMES, AND.HE WOULD LIKE TO <br />CHANGE THE ZONING FROM ALLOWING 15 UNITS AN ACRE TO Z PER ACRE. MR. <br />SILVERSTEIN FELT THAT YOU WOULD GET A LOT LESS POLLUTION FROM 36 SEPTIC <br />TANKS THAN FROM 300 CUSTOMERS ON A SEWER -LINE, <br />ON MOTION BY COMMISSIONER DEESON, SECONDED BY COMMISSIONER <br />'SCHMUCKER, THE BOARD UNANIMOUSLY CLOSED THE PUBLIC HEARING. <br />ON MOTION BY COMMISSIONER DEESON, SECONDED BY COMMISSIONER <br />SCHMUCKER, THE BOARD UNANIMOUSLY ADOPTED ORDINANCE N0. 77-35 GRANTING <br />THE REZONING TO R -IA REQUESTED BY MR. SILVERSTEIN ON THE CORRECTED <br />LEGAL DESCRIPTION AS SHOWN IN THE ADVERTISEMENT. <br />35 <br />DEC 71977. <br />
