v <br />ASSISTANT PLANNER BERG INFORMED THE BOARD THAT THIS PROPERTY <br />IS ON THE NORTH SIDE OF WABASSO ROAD EAST OF. 64TH AVENUE., HE NOTED <br />THAT THE PLANNING DEPARTMENT HAS JUST RECENTLY COMPLETED A STUDY OF <br />THIS AREA AND RECOMMEND REZONING OF WABASSO ROAD. THE STUDY AREA WAS <br />STOPPED JUST TO THE WEST OF THIS PARTICULAR SITE, MR, BERG NOTED THAT <br />THE APPLICANT WANTS TO BUILD A HOME ON THIS PROPERTY, AND THE ZONING <br />BOARD HAS RECOMMENDED THAT THE ZONING BE CHANGED, IT IS IN KEEPING <br />WITH THE COMPREHENSIVE PLAN. THE PLANNING STAFF ALSO RECOMMENDS AP- <br />PROVAL. MR. BERG FURTHER NOTED THAT THERE ARE STRUCTURES LOCATED ON <br />THIS PROPERTY, BUT THERE IS AMPLE ROOM FOR BUILDING ANOTHER SINGLE- <br />FAMILY RESIDENCE. THE.PROPERTY WOULD HAVE TO BE SUBDIVIDED, HOWEVER. <br />HE NOTED THAT A SMALL PIECE IN THE CENTER OF THIS PROPERTY IS OWNED BY <br />A RELATIVE OF MRS. MOWATT, <br />ATTORNEY COLLINS ASKED IF THE STATUTORY NOTICE WAS SENT TO <br />THIS RELATIVE, AND ZONING DIRECTOR WALKER STATED THAT MR. BROXTON WAS <br />SENT NOTICE THAT HIS PROPERTY IS INCLUDED IN THIS REZONING REQUEST, <br />AND HE HAD NO OBJECTION. <br />ATTORNEY COLLINS REQUESTED THAT MR, WALKER SHOW HIM THE NOTICE, <br />AND MR. WALKER LEFT THE MEETING TO LOCATE IT, <br />THE CHAIRMAN ASKED IF ANYONE PRESENT WISHED TO BE HEARD. THERE <br />WERE NONE. <br />COMMISSIONER SIEBERT ASKED IF MRS;'MOWATT FULLY UNDERSTANDS <br />WHAT IS REQUIRED FOR SUBDIVIDING. MR. BERG STATED THAT HE HAD EXPLAINED <br />IT TO HER, AND MRS, MOWATT STATED THAT SHE IS AWARE OF WHAT IS REQUIRED, <br />ON MOTION BY COMMISSIONER Loy, SECONDED BY COMMISSIONER <br />SCHMUCKER, THE BOARD UNANIMOUSLY CLOSED THE PUBLIC HEARING, <br />ATTORNEY COLLINS NOTED THAT THERE HAVE BEEN PROBLEMS WITH <br />LEGAL DESCRIPTIONS THAT HAVE BEEN SUPPLIED TO THE ZONING DEPARTMENT AND <br />SUBSEQUENTLY -TO THE BOARD FOR ACTION, HE FELT IT IS UNFAIR TO REQUIRE <br />THE PERSONNEL IN THE ZONING DEPARTMENT TO ASSUME THE BURDEN OF WRITING <br />DESCRIPTIONS FOR PUBLIC NOTICES AND SUGGESTED THAT WE CHANGE THE ORDI- <br />NANCE TO REQUIRE APPLICANTS TO SUPPLY THE ZONING DEPARTMENT WITH A <br />.SURVEY OF THE EXACT REZONING THEY DESIRE.
