c <br />ZONING DIRECTOR WALKER PRESENTED DEEDS SHOWING THAT MR. <br />DRINKARD STILL OWNS 100' OF THIS PROPERTY, WHICH HE PREVIOUSLY DIVIDED <br />WITH HIS BROTHER, AND HAS OWNED IT SINCE 1973, MR. WALKER STATED THAT <br />,c <br />THERE ARE 10 OR 11 HOUSES ON PELICAN LANE, AND THIS IS A ROUTINE REQUEST. <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />Loy, THE BOARD UNANIMOUSLY GRANTED A SPECIAL EXCEPTION TO ORDINANCE <br />74-20 TO DONALD DRINKARD SO HE MAY BUILD A RESIDENCE ON HIS PROPERTY. <br />GEORGE BRAKEY APPEARED REPRESENTING MARTHA LIGHTENBERG,. WHO <br />IS ALSO REQUESTING A SPECIAL EXCEPTION IN ORDER TO BUILD A HOUSE ON HER <br />PROPERTY WHICH SHE HAS OWNED SINCE 1957. MR. WALKER PRESENTED ATTORNEY <br />COLLINS WITH A DEED WHICH VERIFIES MRS. LIGHTENBERG'S OWNERSHIP. <br />DISCUSSION FOLLOWED AS TO ACCESS TO THE PROPERTY, AND MR. <br />BRAKEY STATED THAT THERE IS LAND SET ASIDE FOR A RIGHT-OF-WAY, AND <br />MRS. LIGHTENBERG DOES HAVE A LEGAL WAY IN AND OUT. <br />COMMISSIONER SIEBERT POINTED OUT THAT NO LEGAL INGRESS AND <br />EGRESS IS SHOWN IN MRS. LIGHTENBERG'S DEED. <br />ZONING DIRECTOR WALKER STATED THAT OTHERS IN THIS NEIGHBOR- <br />HOOD DO HAVE DEEDS SHOWING INGRESS AND EGRESS, BUT FOR SOME REASON, <br />MRS. LIGHTENBERG'S DEED DOESN'T SHOW IT. <br />MR. BRAKEY STATED THAT THERE IS A 20'-30' EASEMENT THERE, BUT <br />NO ONE OWNS IT. IT WAS NOTED THAT SOMEONE MUST OWN IT, PROBABLY THE <br />ORIGINAL OWNERIAND THIS MUST BE DETERMINED. <br />ATTORNEY COLLINS NOTED THAT THE SPECIAL EXCEPTION COULD BE <br />APPROVED SUBJECT TO VERIFICATION THAT THERE IS LEGAL ACCESS TO THE <br />PROPERTY. <br />MOTION WAS MADE BY COMMISSIONER SIEBERT, SECONDED BY COMMIS- <br />SIONER SCHMUCKER, TO GRANT A SPECIAL EXCEPTION TO ORDINANCE 74-20 TO <br />MRS. MARTHA LI-GHTENBERG SUBJECT TO VERIFICATION THAT THERE IS LEGAL <br />ACCESS TO HER PROPERTY. <br />MR, BRAKEY INFORMED THE BOARD THAT THE PROPERTY APPRAISER'S <br />RECORDS DO NOT SHOW THIS EASEMENT, AND IT IS NOT ON THE TAX ROLL. <br />ATTORNEY COLLINS STATED IT WOULD APPEAR THE APPLICANT DOES <br />NOT NOW HAVE LEGAL ACCESS, AND -THIS MUST BE CLARIFIED.
