<br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN
<br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING,
<br />ABANDONMENT, VACATION AND DISCONTINUANCE OF A PORTION OF IST
<br />COURT SE (AVENUE D) LYING SOUTH OF 22ND STREET SE (WATERS
<br />STREET) BETWEEN LOT 5 BLOCK 6 AND LOTS 1 & 2 BLOCK 2 AS SHOWN ON
<br />THE PLAT OF FLORIDA RIDGE NO. 2, RECORDED IN PLAT BOOK 4, PAGE 80,
<br />PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA, AND AMENDED
<br />PLAT RECORDED IN OR BK 8, PAGES 178 AND 179, OF THE PUBLIC
<br />RECORMOF INDIAN RIVER COUNTY, FLORIDA.
<br />WHEREAS, on June 7, 2011, Indian River County received a duly executed and documented
<br />petition from Steve Shieder, requesting that the County close, vacate, abandon, discontinue, renounce
<br />and disclaim any right, title and interest of the County and the public in and to a portion of 1st Court SE
<br />(Avenue D) south of 22nd Street SE (Waters Street) lying between Lot 5 Block 6 and Lots 1 and 2 Block
<br />2 as shown on the plat of Florida Ridge No. 2, recorded in Plat Book 4, Page 8, Public Records of
<br />Indian River County, Florida, amended in OR Book 8, Pages 178 and 179 of the Public Records of
<br />Indian River County, Florida; and
<br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to consider
<br />said petition was duly published; and
<br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and
<br />report, and testimony of all those interested and present, the Board finds that the subject right-of-way is
<br />not a state or federal highway, not located within any municipality, not necessary for continuity of the
<br />County's street and thoroughfare network, and does not provide exclusive access to any private property.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
<br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that:
<br />All right, title and interest of the County and the public in and to that certain right-of-way
<br />segment more particularly described as follows:
<br />THAT PORTION OF AVENUE "D" (PLAT) 1sT COURT SE (POSTED), LYING
<br />SOUTH OF THE SOUTH RIGHT OF WAY LINE OF WATERS STREET (PLAT)
<br />22ND COURT SE (POSTED), LESS THE NORTH 66.60 FEET OF THE WEST 60.00
<br />FEET THEREOF, SAID RIGHT OF WAY BEING SHOWN ON THE PLAT OF
<br />FLORIDA RIDGE NO.2 ACCORDING TO THE PLAT THEREOF, AS RECORDED
<br />IN PLAT BOOK 4, PAGE 80, OF THE PUBLIC RECORDS OF INDIAN RIVER
<br />COUNTY, FLORIDA.
<br />is hereby forever closed, abandoned, renounced, disclaimed, and vacated, except that a 15'
<br />utility easement (7.5' on each side of the new property lines) is retained (see exhibit).
<br />2. The closing, vacation, and abandonment of this public right-of-way are in the best interests of
<br />the public.
