Section 33 . REVIEW OF BOUNDARIES OF FRANCHISE If determined necessary by the S . W . D . D . , within one year from the date of this Franchise and Contract , the S . W . D . De shall review , calculate and revise the boundaries of the exclusive residential collection service area and residential recycling service area ( based on the previous year ' s billing and service area and , also , in the event of any dramatic and inequitable growth in any part of the County , as verified by the S . W . D . D . ) , and shall make adjustments so that there is an equitable boundary for each franchisee / contractee . Any revised residential service areas shall be contiguous parcels and revision shall be made so as to minimize disruption and / or changes in service to existing customers . Any revision to the residential service areas shall be subject to the approval the Board under the same procedures for rate increases as provided under section 17 . 4 . Section 34 . Other Franchisees The Board may add other collectors or award additional franchises if after public hearing the Board determines that it is necessary or in the best interest of the public . Section 35 . EXECUTION If any word , section , clause or part of this resolution is held invalid , such portion shall be deemed a separate and independent part and the same shall not invalidate the remainder . IN WITNESS WHEREOF , the Board of Commissioners of the Solid Waste Disposal District of Indian River County has caused the Franchise and Contract to be executed in the name of the Solid Waste Disposal District by the Chairman of the Solid Waste Disposal District , and its seal to be affixed and attested by the Clerk of the Circuit Court , all pursuant to the resolution of the Board of Commissioners of the Solid Waste Disposal District adopted as of the day and year below first written . - 41 - TCFRANCH .
