0 <br />-10- <br />e <br />for the major portions of each separate specialty of the work to <br />be inserted on the plans. <br />SECTION XIII - WARRANTY <br />The Engineer warrants that he has not employed or retained any <br />company or person, other than a bona_fide employee working solely <br />for the Engineer, to solicit or secure this Contract, and that he <br />has not paid or agreed to pay any company or person, other than a <br />bona fide employee working solely for the Engineer, any fee, <br />commission, percentage fee, gifts or any other_ considerations, con- <br />tingent upon or resulting from the award or making of the Contract. <br />For breach or violation of this warranty, the County shall have <br />the right to annul this Contract without liability. <br />SECTION XIV - CANCELLATION OF AGREEMENT <br />In the event that the Engineer willfully violates any provisions <br />of this Agreement or performs same in bad faith or unnecessarily <br />delays the performance of the work , the County may declare the <br />Engineer in default and notify him in writing to discontinue fur- <br />ther performance of the Contract. Payment shall then be made in <br />accordance with Section XI above. It is mutually understood and <br />agreed, however, that neither party hereto shall be held respons- <br />ible for delay in_performing hereunder when such delay is, due to <br />unforseeable causes which cannot be reasonably forecast or against <br />which provisions cannot be made, such as acts'of God or a public_ <br />enemy, fire, strikes, floods or legal acts of public authorities. <br />This Agreement shall be considered terminated by mutual consent if <br />FEB S 1978 33 FAc 5 1 42 <br />
