Mid -Florida hereby agrees that any and all loss, damage, <br />or destruction of all or any part of the Mid-Florida.system or <br />its customers' systems, and any of its customers' property arising <br />out of any water pressure, or lack of water pressure, or for any <br />other loss, damage, or destruction, arising out of service provided <br />S&t vikq <br />under this agreement, orA outside of this agreement, whether or not <br />same results from the sole negligence of the City's employees or <br />city's agents, shall be the sole responsibility of M -id -Florida or <br />g <br />its successors. <br />6. The service to be provided under this agreement is limited <br />` <br />to assisting Mid -Florida in meeting its demand above its current <br />availability of water within the Mid -Florida service territory, in- <br />cluding Mid -Florida's wells, and Mid -Florida hereby agrees that it <br />will at all times utilize its wells to the greatest extent possible <br />and will utilize the City's water only to the extent absolutely <br />.necessary to meet the demand of Mid -Florida's customers above Mid - <br />Florida's ability to serve. Mid -Florida shall utilize its best <br />efforts to alleviate its"`problems of water shortage by taking all <br />reasonable acts necessary to clean, renovate, or modify its existing <br />wells to procure additional water therefrom. <br />7. The City shall not be required to supply to Mid Florida in <br />excess of 100,000 gallons for any one day. Mid -Florida shall pay <br />the City 75C per each 1,000 gallons of each day's first 100,000 <br />gallons, with a minimum charge of $75.00 per day irrespective of <br />actual usage. In the event that Mid -Florida takes more than 100,000 <br />gallons of water on any day, it shall pay a charge of 90t for each <br />thousand gallons over that day's 100,000 gallons. A day shall be <br />from noon to noon. <br />8. The City has heretofore provided for the temporary emergency <br />use and availability of water to the Mid -Florida system, a 4" fire <br />• <br />hose between a fire hydrant of the City's system and a fire hydrant <br />of Mid -Florida's system, at 5th Avenue and 18th Street. This fire <br />hose connection has been removed upon the installation of both the <br />6" water main and the -8" water main described below. Mid -Florida <br />f, <br />shall pay to the City for said fire hose the City's total cost thereof, <br />plus 10%, plus installation labor plus 30% thereof.
