Stevens. <br />ABSENT: None. <br />Mr. Little opened the meeting with a five-page summary of notes <br />that had been gathered together by the staff and the various <br />comments given him by•Council members. He stated that there <br />were four areas of concern; water resources for additional supply <br />of raw water, the cost to acquire the additional supplies, the <br />staff and financial commitment and disposal of sludge. <br />Mr. Lyons believed that before Council could address the problem <br />of water resources, they should assess what long-term commitments <br />the City has as far as water to total development of the City of <br />Vero Beach and the binding contractural agreements the City has <br />with areas outside the corporate City limits. After further dis- <br />cussion, the City Attorney gave his interpretation of the areas <br />delineated by the so-called tripartite or bi-lateral agreement <br />and its annexes. <br />Mr. Palmer stated that -the City had an agreement with the Town of <br />Indian River Shores in the original tripartite agreement that stated <br />the City had a Crater supply responsibility but not a water distribu- <br />tion responsibility. The City of Vero Beach has the responsibility <br />under the agreement and annex to provide service and distribution to <br />the Town of Indian River Shores for water. We have no responsibility <br />to provide distribution service south -of the City limits on or off <br />the beach, other than that which is contained in the 1,000 one -inch <br />equivalents within the Moorings' acreage area. Water service under <br />the agreement was limited to 1.3 MGD at the plant for water and 1.39 <br />MGD at the plant for sewer service to the county (excepting the <br />Moorings). It was Mr. Palmer's opinion that since the county alloca- <br />tion for water is used up, there is no water available for that area; <br />and since Annex No. 1 was signed, the City had no responsibility to <br />serve or distribute water in the area south of the Moorings. Mr. <br />Palmer stated that the Annex said that the county would assume the <br />responsibility for water distribution within the county. Mr. Palmer <br />stated that the Annex contemplated that the county would come right <br />up to the plant with their facilities and that the City would assist <br />with the granting of easements on facilities within the City limits. <br />The City Attorney stated that there were several areas in the county.,. <br />adjacent to the City such as the Country Club area where the City <br />already had service. It was assumed by the agreements that these <br />areas would remain as the City's water service areas and if the <br />county ever put in.wastewater facilities, the City would sell them <br />the water facilities also. <br />The Mayor reiterated the salient points that.the present customers in <br />the county were all that the City had to serve, that the County's <br />allocation of water and sewer is essentially used up. We have 17 <br />years to go on the Indian River Shores agreement. In addition, we <br />have existing; customers in the county that bring that allocation <br />to 1.5 million gallons. The City is serving the Moorings under the <br />1,000 one -inch taps in a selected amount of acreage. <br />Mr. Little delineated further areas of concern. He spoke of water <br />treatment sludge disposal being a problem in the future and mentioned <br />that if -the water treatment plant was ever expanded a possible method <br />of disposing of the sludge would be to put in a calcifying and drying <br />plant which would create more lime than i;: used by the system.
